Ebay Console but not as discribed!!! Opinions please?

This is what the guys listing stated
Microsoft Xbox 360. Fair physical condition, but suffers from the problem of freezing every so often. Sometimes it can go a whole film without freezing and others it's every 5 minutes. I have looked into it and it can be fixed but I haven't the time at the moment. The cover to the USB ports is also stuck open but both ports are still totally usable. The console casing has never been opened. For sale is the console only no hard drive or wires. Having trouble with camera at moment but if you want pictures I will add them later.
Q: hi sorry but your description has baffled me you mention freezing when watching films?? does this item play games??
A: Yeah it has been better with games, it doesn't freeze as much but I watch a lot of films on it to. Does that help? Oliver
When i recieved it today the dvd drive would not even open no matter what i tried so i opened the console and then the drive and well...

Surely that drive could not of been working as stated in his listing could it? I feel i have been lied to realy but i dont want to return it and end up paying the postage costs, it aint worth it.
I also have a spare hitachi drive the i could flash and put in there so im not that bothered as i am able to fix it but then i might still have to deal with the freezing problem he mentions.
Thats if its even the same console he's on about???
Can anyone comment on how they would handle this particular situation?
1: Would you leave neg feedback (he deserve it really)
2: what would you say if you was to contact him, part Refund maybe in return for positive feedback :/ lol
Help me out please i aint really good with these situations

i would send him a message first stating that drive wouldnt even open, and all that. then if he doesnt want to offer a partial refund, turn it into paypal/ebay for item not described.
side note--
i think tomorrow i get my money back from the jackoff that hasnt sent me my benq drive yet.

yea but Wabash, if i do send him a message and he don't offer a partial refund and i then go down the paypay/ebay item not as described route, would i then have to return the item and him return the money??
Coz that would mean me paying for the return postage wouldn't it?

when you file your claim, just state all you would like is a partial refund, or it has to be returned then the buyer should pay for return postage as he mislead you.

Hi there,
I received the xbox today and i am wondering if this is the actual console stated in your listing.
When i turned the console on the drive would not open at all. I tried multiple times but to no avail. I then decided to open the console and the dvd drive to see what was going on.
When i took the top off of the dvd drive it would open but then make a funny sound and close again automatically.
I then noticed that the circuit board inside the drive was covered in a black substance, please take a look at this picture

In your item description it clearly states that
"Sometimes it can go a whole film without freezing" and then your answer to this Q confirms " does this item play games??

That black substance is epoxy that M$ had placed on the legs of the chips to make it harder to solder mod chips to or get the chips off the board to decrypt.
He might have been using it as a media center or running netflix off of it but he would have know if the drive wouldn't eject properly and should have stated it in the ad.
The drive could be fixed so I would only ask for a 10 dollar refund and be happy but that's just me.

Samsung drives are notorious for sticking trays. The most common reason is dust/dirt build up on the gear belt (the black rubber band). That build up allows the belt to slip, resulting in the tray not opening.
Use a cotton swap and rubbing alcohol and clean the belt and gears. Also clean off the laser eye with it.
As for wanting the seller to rectify the situation, now that you've opened the console, he doesn't have to do anything about it. And going to Ebay or Paypal to file a claim would be useless seeing how he has an email and pictures where you've admitted to opening the console.
But don't sweat it. Worse case is you wouldn't be able to revive that Sam drive so you'd just have to swap it out.

Thanks, Ive done that now and the drive seems to be working much better but it keeps telling me my halo 3 disk needs cleaning but its condition is good and it plays fine on my other console mmmh??
Guess i will let him know it was my bad!, Or should i just see what he says first ;]

Don't think you should of opened the xbox as it was previously unopened, this would of voided any warranty on it.

Well, if it's the original Samsung drive, it's pretty old. The laser could just be at the end of it's life. You could just pick up a new Samsung drive. They can be found fairly cheap for a brand new one. Then you could just swap the old board in to the new drive.
Or, if you're more of the "hands on" type, just buy a new laser.

Think ill check the price diff between new laser (im a hands on type of guy) and a new drive as it might be worth just buying the drive.
But before i do that im going to have to try and resolve this FREEZING issue..??
Any idea's people???
It freezes at the dash board after about 2 mins, I have tried the x-clamp fix, swapping drives/Power switch/fans and i know it aint the psu because it works on other consoles. Im just trying anything as i cant find any verified methods to fix this fault.
mmmh.....would a heat gun attempt be worth a try do you think?

Thats not the type i was meaning as apparently they are nonsense and made of a spongy material. The ones i used were similar to the material of an eraser rubber which is essence will do the same idea as the penny trick.

Things just keep getting better...
I did the penny trick and have now got rrod 0102, what the hell.
not sure if its because of lack of paste on cpu and gpu tho as i had to remove heatsinks in order to do the penny trick due to the hybrid xclamp fix and i aint got any more paste so its looking a bit thin.
Gonna remove the pennies i think and see if i can get back to the dash board.
am i right in thinking that 0102 is ram related coz this would tie into the freezing problem it previously had?

Try using fewer pennies.
I only use 8, 2 per chip and tape them to the mobo so that they stay put.
I also let it run with the fan over the cpu for 30 minutes and up to an hour sometimes with problem boards with Halo 3 or Gears of War running their demos to get the gpu really hot.
I've read some guides that say 15 minutes or only until you get two red lights which never works well for me.
Then again sometimes they work right off the bat and I still let it run just to be sure.
