On Wednesday a Federal judge granted Verizon's request for summary judgement, shooting down all of ASCAP's claims that mobile phone providers should pay public performance royalties for ringtones they sell. The sale of ringtones already requires the seller to pay mechanical royalties to the publisher (songwriter) and recording artist, just like MP3s or CDs. I guess they will appeal to a higher, better bribed court.

It is only a matter of time before the law states that simply having an MP3 is a public performance, even if it is never played.

So if the carrier is forced to pay a fine for making a "Public Performance," can I get paid as being the "Producer" or "Performance Organizer?"

If ASCAP wants to go out on a limb with these ridiculous claims, why can't I?
