Was hoping it would be just a straight forward answer but obviously not.

Ban wave has hit Hong Kong hard - 5 days now. My console was banned today. Fortunately I was able to just change the mb for the fraction of the price of a new console. I now have an unmodded console and no more fear of being banned. Also bought an original MW2 in the process. Tomorrow I'm getting GOW2 and Halo ODST. I'm all legit now. It was fun while it lasted.

Got banned early this morning, so ban wave has not subsided yet. I had played MW2 early,(without hd or ethernet connected) and have played 1 game that failed a abgx scan (stealth passed, verification failed). Had xbox for under 2 months. can confirm that hd backups no longer work, although Media center with windows 7 ultimate, still works fine, contrary to some reports. Took the risk and will be a bit more careful next time round

My unlucky day sure came. Luckily I was prepared.
I heard that if you call MS support, in regards to repairing your console, they tell you if it's flagged for ban or not. They told me it was, so I've completely disconnected it, and it will remain a not-yet banned console for offline use, mainly for playing games early, and I will buy a broken console to get fixed and use that as my LIVE console.
I did play games early, I played the offline and some were bad rips. Don't know if you guys heard, but there's new firmware being developed by C4eva - http://www.xbox-scene.com/xbox1data/sep/EkVZlFElEAbFXHUMfm.php
I may hold out on flashing my new console until that is released.

I too got hit by the Ban Wave. I don't really care for playing online - I didn't even have XBox Gold - just the Silver option. What stings most is that I lost the HDD functionality. I had all my games installed - for faster loading times, etc. Now it is back to the DVDs. Don't think I will be able to buy another XBox -- the wife warned me before I had this one modded. Just depressing. I will try and erase the HDD, and roll back the Dashboard, and see if that does anything. If I can get the games to install on the HDD, I don't care about connecting my Box to the Interwebz again.

I have 2 consoles and used to transfer my gamertag between them to update my gamerscore on live. Well anyway, I started getting lazy and instead just used the modded console to update my score. Now that's been banned. Doesn't pay to be lazy. lol Now that my console is banned, I thought, I can still play "backup" games and then update my score on live with other xbox, but whenever I transfer my tag between the console, I think the banned console corrupts my gamer profile and I need to keep recovering it. Is that one of the effects of having a ban or am I just unlucky? o.0
Could somebody let me know please?

apparently this is one of the symptoms of the new bannwave + october update. according to sources "your banned xbox cannot be used to get achievments from backups without corrupting your profile"

If all these console bans are in fact true, it should be interesting to see what this does to the secondary market for used consoles. People will be selling XBL banned consoles to completely unsuspecting and not-in-the-know customers, who will in-turn try to use their console as a legitimate console on XBL and be told that they are banned - no further information can be given - and there is no relief for them.
That's like you buying a used car from the lot, and when you try to drive it on the highway the government tells you that you can't because the previous owner had too many DWI's... lolol... But you can still use it in your driveway to listen to the radio.

What about if you use the internet repair function, just checked and my status is still, "under warranty". My xbox is fine atm, but this sucks if things go wrong down the track

It will not work. Onced flagged, you lose your warranty.

Thanks I also tried this and found out I was banned, Lady said she had to run tests to see if I was elgible for a repair. Do you think they recovered my data then? System hasnt been online for the whole ban wave. But the system I ran test on seems to be working perfectly fine and still no ban. I wonder if calling brought on attention and got me banned lol anyway good test atleast i can truly keep a system for offline play and achievements. Thanks

Nah they don't recover anything. Once you're flagged to be banned, it'll be noted on the system that the employees use. No problem, I recommend to anyone that isn't yet banned to do this. You don't ask if you are banned, you just "inquire as to whether or not your console is eligible for repair. If it is, then say thanks, and just end the conversation there, if it's not, they will tell you, "No you cannot get it repaired because it says here it has violated the terms and conditions"
If you do this, you've got yourself an offline console to play games early on with the same profile you use for Live, and can keep the achievements rather than end up with corrupt data when you move it to another Xbox.

well it appears that Microsoft those money hungry bastards have banned people that have been caught playing bootleg copies or pirate copies or bad rips some people however that i have contacted via craigslist have told me that they don't know how they got banned and have not played any bad rips and have not played any game prior to its release date. people please stop playing a copy version of codmw2 it is causing the problem for most. there is no solid patch of stealth for it as of yet. I have heard of this guy out in los angeles that can fix it i wouldnt know how because after doing some research i know that they ban the serial number from being able to go onto live so the only way to get back from being banned would be either get a new xbox which isnt fair to alot of people... i personally say so what you pirated a game you didnt want to pay $60 for... good i do the same and if you dont like the idea of people doing that then guess what you pay for my game bitch. dont get me wrong i have a mod and havent been banned so its not like im mad for any other reason than to say god dammit microsoft we pay for the *bleep*en console we pay for the *bleep*en live leave us the *bleep* alone you already make crazy money let the poor people do what they have to do to play some games cause dammit 60 for a game is stupid its too much so i hope microsoft either loses customers and alot of money and people start to play with the ps3 if i were sony i would captalize on this and lower my games sorry went off into a tangent the other option i heard you can do so far is get the serial number changed in your motherboard which you need an unbanned 360 i hope someone with a higher Intel level can make a chip to install into the 360 to make it unbannable. so far the only thing you can do before you get banned is download the 1.7 version of the mod. now i could be wrong with anything i said here so please everyone feel free to comment get back to me start an argument either way if you pirate then good for you don't let this slow us down at all let this make us smarter and stronger and for the people that hate those who pirate the only thing i have for you is a good ole *bleep* you asshole not everyone can pay for games like you can mother *bleep*er so go suck on your mothers tit for the 60 bucks for that game you want. as for everyone who got banned i hope for a cure to this disease and for everyone who is scared of getting banned then don't go online just yet wait for a better solution to this as to Microsoft you made the flaw to an awesome system we made a way to get games for free so guess what *bleep* you guys then i hope you keep losing money i hope you lose more money for doing this then you lose for just leaving us poor people be.

Its definatly the firm ware that they are detecting ive not played any 4 wave games,never played early releases and i download and patch all my own games. just got home from work with an original copy of cod mw2 and as soon as my console connected to xbox live i got banned gutted. to help my friends out does anyone no if you dont go online from now till you get this new firmware installed on your xbox will you be alright or is it time for a new xbox lol
