Yup there was one that was leaked about 7 hours ago, but it was missing the SS, PFI and DMI Files, so unless you really want to be banned, you wouldn't want to play it.
But, supposedly there was a copy leaked after that had the necessary files, so people can just grab the SS, PFI and DMI files from that rip and patch the game.
There is a download somewhere for those specific files too...

That rip looks suspicious to me. If you look at the details of the video partition in the abgx360 log, it gives different details to all other wave 4 games. Every wave 4 game I've downloaded gives this result in abgx360: -
Video CRC = 1914211B (V0 = 29D07E66, V1 = EAE76B94)
Tekken 6, GTA: Liberty City, Fairytale Fights, Madagascar Kartz, CSI: Deadly Intent, Cars Race-O-Rama and Bakugan Battle Brawlers all give the exact same result because they all use the same video partition, so it should never differ.
Here's the details from the Modern Warfare 2 rip: -
Video CRC = D28A9228 (V0 = 29D07E66, V1 = 11F8FAFC)
There's only two reasons for this. Either it is yet another new wave, which is unlikely as the game is released before the next dashboard update, which doesn't come out until the 17th, or it has been modified. My guess is that someone took that other release that had no video partition or stealth and patched it up. Either way, unless you have a banned console, I wouldn't go near this.

I didn't advise at all to not play the game, I just said people that play it early will probably be banned. I'm playing it cause I really don't care if I get banned! It's happened before, and it will probably happen again! Not a huge deal to me!

I have not downloaded it yet. m$ put out a statement that all modded boxes will be banned so i dont know if its worth it yet. then again if i get banned for previous shit that i have done i might as well play it anyways

I played cod 6 and a non xbox live profile and unplugged my wireless usb...will i get banned when i go on my live account even tho i didnt play on that account?

Someone has patched those versions, so they are not safe to play. They wouldn't be safe to play anyway because it's 10 days before the release date and neither are verified. Didn't people learn from the Forza 3 bans? lol. If you're already banned or you don't care, then fair enough, but if you do care then don't even waste your time downloading these releases, never mind playing them.

If you have this video CRC:
Video CRC = D28A9228 (V0 = 18066DD3, V1 = 11F8FAFC)
The video.iso has not been patched to the game. I'm pretty sure this won't play on iX 1.61.
If you have this video CRC:
Video CRC = 1914211B (V0 = 29D07E66, V1 = EAE76B94)
More than likely another Wave 4 game's video.iso was patched to it.
Now just looking around, this CRC is suppose to be a Retail RF rip:
Video CRC = 519081E6 (V0 = 823DC656, V1 = EAE76B94)

No. The original rip was not ripped properly. So it didn't rip video partition properly either.

IMO, Modern Warfare 2 will be wave 4. I've seen 4 different versions now, all with different Video CRCs, so it's pretty obvious that people are just patching them up. Only 1 of the versions has the proper wave 4 CRCs, but that doesn't mean it's legit. It might just have been patched by someone who knows what they're doing.
If it is wave 5, then I hope the firmware team make a version of the latest iXtreme that doesn't have strict video wave compliance, because I don't want to be updating my firmware all the time just because of that.
