Hey all!
I know this thread has gone way off, but enough with the childish crap!
I think the game that flagged consoles was the Batman Arkham Asylum. I've had my console modded for some time now, and my previous games were:
Fallout 3
Need for Speed Shift
BlazBlue
Fable 2
Resident Evil 5
The NEXT DAY i had played my copy of Batman, i was banned. THat day being today... them dudes are QUICK! LOL
But hey, what can you do? I got caught and thats all there is to it, no need to fuss, it's risk we all take right? Anywho, I hope this helps.

You need to look more into how the drives are designed. Microsoft cannot see the firmware that is being run on the drive because the firmware is locked out. It's the protection they built into it (trying to keep hackers out as well). The "backdoor" MS left themselves to check firmware is the ability to issue challenges to the drive/firmware. We know all the challenges, so a hacked drive is capable of giving the correct response.
The only way the firmware could be detected is if there are new challenges being made by MS. As of a week ago (beginning of ban wave) there was not.

Now, think for a second, why else is everyone getting banned? Playing early copies, corrupted copies? They can tell if your playing a pirated copy if its not stealthed and has been corrupted. Everyone already knows that.

Anyone that believes microsoft, a multi billion dollar company (that has known their share of pirates from previous products) who *****MADE***** the system can't detect a modified console is just an idiot.
Go look at the info people are posting, they show no trend and everything points to MS being able to detect modified consoles... unless you want to keep believing whoever told you they cant. I'm sure team hyper x c4e or whoever made modified consoles possible are smart and all, but come on this is microsoft we are talking about.

This logic is just wrong. You don't seem to remember that most people do actually hack to play illegally obtained games. With this, even if MS bans them, they would not switch to PS3 because they would have to buy ALL their games (seeing that the ps3 has yet to be hacked). Rather, the banned individual would make the cheapest financial decision and buy another 360 (since it can be hacked), if he/she buys one at all. They might just decide they don't care that much about live and be fine with what they have.

my mates banned 360 - fw ix1.6 ms25 drive.
games halo odst, dirt 2, grid, cod4.. halo odst..
i honestly believe that microsoft are putting out early releases with built in hackbusters.. its not like the programmers aint capable of it,, you know,, like the spyware you get on your home pc that grabs info from your pc & sends it somewhere,, difference been the 360 has no anti virus, antispyware etc & even if it did - microsoft will always have admin access to your 360 by dumping files with communication scripts built in,,, so maybe they give you a game via torrent with a little script saying 'hey this ones a skank' & then you get a system update for retrieving that skank tag & bang - your live is gone !! but hey,, its all just speculation & by the look of this thread - lots of childish squabling !! my 360 isnt banned - i wiped my system cache, formatted my drive, did a reset & retrieved my gamertag - exact same 360 & fw as my friends !!! maybe a fluke,, maybe not,, who knows ??? bet your ass microsoft does !!!

Two more friends got banned this morning. Both modded around six months ago, liteons with 1.6. One never played games early and the other did unplugged. Shoot, one did more netflix junk then actual gaming.
I still say the custom firmware has been busted.

Well as long as he watched more movies than he played bad rips, he should be just fine! LOL.
$38 on new discs -- Check
$15 on burn after burn that showed as a DVD -- Check
