WRONG! you take risks with a flashed console, and banning is a high possibility

ps2: v7 scph-39001 - independence exploit - hdloader 0.8c - maxtor 300gb hdd
(+[__]%) psp slim ta-085v1: 6.60 PRO B10
wii (powered by bootmii/priiloader): 4.1u - d2x v10beta53-alt (base 56) - configurable usb loader v70r51/devolution r188 - wd scorpio black 7200rpm 320gig w/ ams venus ds2 enclosure

got a whole lot more to list . . .

the 169 ip address might be related to your router, try giving it a static ip address that falls in the range of ip addresses that your router supports. as long as you are not banned from live, it doesn't seem likely that it is related to flashing your dvd drive (how then can it be?!!). even if you are banned, it also seems unlikely that it is related. unless you updated your dashboard and MS somehow inserted some sort of banning software so that your xbox 360 cannot obtain a valid ip address besides being banned from live. but that seems unlikely to me, way to complicated. so it seems unlikely that a banned console would also have problems obtaining an ip address.

169 IP adddress is when you XBOX is unable to get a IP via DHCP, so the xbox assigns itself this IP. This is nothing to do with banning!

dennisv9 is right to say try assign a static IP, a factory reset of your router may also help.

I would try a different cable with this setup.
Power off, power on? Reboot the router?
But what it really sounds like to me is a dead network port.
Try a different port on your router, or it may be the XBox itself.

perhaps the network port is dead...

what you can try, is connect your xbox directly to your modem (without the router) or connect the xbox to your pc (cross cable). in both cases you take at the router variable, if your router is the problem than you will find that out (off course set it back to dhcp if your modem is set to dhcp; same if you connect it directly to your computer!).
if that all doesn't work (and you tried another utp cable off course), maybe your nic port is dead

i have a feeling that you may be right with the broken port becuase i have tried directly to the modem and a different router. it would make sense because i think it hapened around the time my xbox fell of the ent. unit and landed on the floor boards. ill try a mate of mines xbox and at worst i get a new 250gb console and uae my flashed xbox as an offline console since it hasnt been banned.

You could always try a wireless adaptor! I have a spare 360 with a knackered ethernet port but the usb ports work fine.

You probably have a bad nic. Either get a wireless nic or get a usb to LAN adapter.

that sounds pretty hostile.
just as an update i still havent had a chance to test another xbox, but i noticed that the connected light shows on the router. this is swaying me to think that it could be something else. could someone convince me that it is the xbox and this situation is possible.

I don't need your permission to post or not, as i said i'm subscribed to keep an eye on the hostility that you're experiencing, hence that's how i'm helping. As per miketrev above, a 169.x.x.x address is due to lack of a DHCP address. Try using a static IP outside of the DHCP range. Trying the kit at another house doesn't necessarily prove anything as you're unsure of your networking abilities (smiley added as not being sarcastic) :)

Why not just buy a wireless adapter (or usb to lan adapter) and save yourself some cash?

no, it's a class C address, while yes you could use 255.0.0.0 his gateway and ip fall inside the same subnet and is perfectly acceptable
