Gilham sold the modded consoles, which allow users to play back pirated games, from 2003 until 2006. His appeal was based on the issue of ?whether the playing of a counterfeit DVD involves substantial copying of ... [ read the full article ]

Well it's frowned upon now but there's nothing that says it's illegal, just copying games you don't own and such is illegal.

And thats how it should be modded stuff stay out of the normal retail sectors and selling copy stuff should bring in enforcement ...you can;t lump it all together.... as the media mafia is trying to do...

Actually it is illegal in Canada now, its just not widely cased as it is not in Canada's top priority. It's called reverse engineering. If you really want to find out tho, you could always ask the local law enforcement. I suggest tho, that Canadians who do have a modded system, keep it on the low; there's no telling when laws will be enforced to keep up with other countries.

Yeah..............I was just asking myself the same question. What is this crap about...

"The various drawings that result in the images shown on the television screen or monitor are themselves artistic works protected by copyright."

He modded but didn't pirate anything. They're just making an example out of him or there is more to this story than meets the eye.

They are convicting him for selling his services as enabling people to commit piracy...they just couldn't make that stick, so they declaired screenshots illigal, after the "crime" was commited.

I don't buy games without seeing an in-game video first...or at the very least, a whole bunch of screen shots. If both of these have become illigal, then I will not be buying games anymore I guess.

Next laws to pass:
-Any photograph with money in it will be considered conterfeiting currency.
-Any picture of a famous artwork will be considered theft from the museum where it is kept.
-You will not be able to send pictures of fruit across boarders.
-Any picture of a person will be considered human cloning...and human cloning is already illigal.
-Writing or saying the name of a company that you are refering to will be considered copywrite infringment...only Microsoft can call themselves Microsoft; saying "Buy Microsoft Windows" would be 2 counts of copywrite infringment.
-Taking a picture of yourself will be considered stealing your own soul, and will be punishable by burning.

excuse me mr policeman but somebody seems to have stolen my soul... whatcha gonna do about that then officer XD

let this be a big warning to anybody in the UK who thinks that modding consoles for money is viable. I guess it's fine to help a friend out, especially if the main reason is to replace a broken drive or something, but just "flash for cash" is too damn dangerous.

Too right ! all we are just doing is moving with the future and leaving the Authorities behind who are obviously too old to keep up now! !

Simply put he was helping people use "illegally" downloaded products.
I think its right the he gets convicted for that. Probably gonna get a flaming for saying that but think of it this way: You buy a game, lets use GTA or GranTurismo as an option, at the time i bought those games for ?60 and ?62 and i played those things for months, i still play GranTurismo every now and then so i really got my moneys worth, those people that work on these games put alot of hard work into these games so i find ?60 a fair price for the amount of pleasure and fun you get from them, if you go and download and burn them they're losing money, so they're going to have to make even more expensive and so you've screwed yourself and the rest of the gaming community in the end.
Go out to watch a film, based on two people: Film ?9 pp, some popcorn and drinks:?10 Parking money and/or fuel used to get there: ?10 and you might go have something to eat or get some drinks after the film....easily over ?60 for ONE evening, with a ?60 game you'll have more than one evening of fun and pleasure......

OK, so the court has now ruled that the process of the data transferring from disc into RAM counts as making a copy of copyrighted work, as does displaying the images on a screen and no doubt playing the audio.

Do the licence agreements that come with each game permit the purchaser to copy the work in these three ways, or is every game player now making unauthorised copies every time they play a game?

MW2?

Copyright infringement is nothing more than civil disobedience to a bad set of laws. Lets renegotiate them.

im in australia and over here people advertise they can mod consoles for a fee and some even give you a receipt and warrenty.if you ask them can my modded console play a copied game after its modded they will tell you it can play backed up games.if you own something its up to you what you do with it.i think this is ridiculous.if you own a car you can modify it for racing and sell it.if you own a sterio you can rewire it to be louder and sell it ect.So why can't you sell a modded console.if that guy ever gets out i hope he comes to australia and starts sell modded consoles we need someone like him over here
