Ive got 1.51 firmware on my xbox at the mo but need to reflash with 1.61. got the Rrod scene version of mw2 thats been fully verified with abgx360. if i reflash at the moment is there more chance of being banned? is the firmware safe? and whats the differance between 1.6 and 1.61

Do you have a link for this version of MW2 please?

Also how do you do the update? Can you see the version of the flash you are on by looking at some sort of recovery mode?

The risk of being banned is there no matter what you do. The difference between iXtreme 1.6 and 1.61 is that the latter has support for wave 4 discs.

If I was you, I'd wait until c4eva releases the new version of iXtreme that he's working on, although it's impossible to say when that will happen.
