i got banned, got new xbox, tried that way to recover my gamertag without having to reformat. Copied gametag to mu, hooked up new xbox, put in hdd and tried to recover gamertag, didnt work. i tried deleting my gamertag, then tried recovering to mu, now its saying "sign up process is unavailable"... could anyone please help me?

did u delete the profile and items? if you did, then your probably out of luck. when i had this happen i put the HDD into my new xbox, deleted JUST THE PROFILE, then recovered it.
