So I'm not sure this will work but if i install the original game to my hard drive and just boot with the back-up disc for the initial startup. This way all the data will be original and i don't have to worry about bad data or anything. Can anyone confirm this

I don't know if you are going to find an answer for this one. We aren't even exactly sure what M$ is doing to identify modded consoles, but I highly doubt installing to an HD would make any difference. If they are challenging the dvd drive's speed, they can still do this while playing from an HD. You have to put the disc in the drive at some point in order to play, which will give them a chance to to their tests on your drive/disc.

all that happens is the discs spins for a moment just to see if that is the correct disc,it doesn't even get up to full speed so i don't see how they would know that. Thats why i asked my question because the disc does not even spin in the drive....

I have a friend that did this and was still unable to avoid the Banhammer. He made backups off retail/original discs. He used a kreon drive to make his rips and shortly got banned after playing Dragon Age: Origins.

When the disc only has to spin up to 10x, it isn't like it takes alot of time to test the firmware. Flashed firmware runs at 12x, so it doesn't take but a second to test it. Even though it's installed, the disc has to spin in order for the xbox to read it, and that may be all that it needs to catch you. This is all speculation, but I know I personally wouldn't risk it.

He probably screwed himself with the kreon. The Kreon has been proved to rip any game with the SSv2 incorrectly.
