Concern for Banned Xbox 360

Concern 1:
So I noticed a lot of people who recently got their xbox banned have been listing their Banned Xbox 360 for sale. And my xbox 360 has been banned, but I'm concern about listing it for sale for the reason that the person I sell it to may go out there to buy a new xbox and swap out the guts of mine and I am worried that I am somehow linked to it as the serial number of the Banned Xbox is previously linked to my account. Can somebody please let me know if that is the case? I can't imagine once I sell my Xbox 360 what other people will do the system. Whatever happens to my banned xbox 360 after I sold it is kind of out of my control what the other user intends to do with it. Should I be worried that I'd be in trouble if anything were to happen?

Concern 2:
I bought a new xbox 360 a week ago and I've been debating to modify it it to play backed up games, but I know if I do, I'd be making myself vulerable to M$ to ban my system. So I have an idea of cloning the unbanned system to a banned system to play backed up games (which will remain off-line). I was wondering if I was able to successfully clone the unbanned system to a banned system, which means I have 2 xbox 360 with the same ID; if I switch HDD back and forth between the 2 Xbox 360s (Un-mod & Modded) to play backed up games off-line, will those game data get corrupted? For example, if I have started playing Forza 3 on the original system, and I take the game data to the modified Xbox 360 to play a backed-up version I created of Forza 3 that's not connected to XB Live, will M$ corrupt my data once I connect to XB Live when I switch back to the un-modified system? Also, can M$ have the right to banned my un-modded Xbox 360? I am not an expert at this, but can M$ detect me playing backed-up games (even when I'm offline)? Does it create the log through my HDD?

I hope I wasn't too confusing...thanks in advance for any feedback or help.

I don't think that there is any problem. Did you register your now-banned xbox and you are concerned of what he is doing with the console? Do you fear some legal problems?!

This depends on whether the banned box "knows" it's banned or not. Let me explain how I do it: I have a banned xbox (but it is not really banned with hdd lock and such, because I got informed about the ban by phoning M$) which I call "offline box". I bought a new Xbox (unmodded) and use the HDD on the online and the offline box. There is no log on the HDD and M$ has no right to ban an unmodded box.
However, you can not clone the ID from one box to another, but that doesn't matter. You can just swap the HDD and use it on two boxes.

But: If you were banned by Xbox Live and you have a HDD lock (i.e. cannot install games) your savegames and gamertag will get corrupted every time you put the hdd on the banned xbox. Then this swapping will not work because you have to restore your gamertag from the M$ servers on the unbanned console every time.

Concern 1:
Yes, I did register my banned x-box when i first bought it and I am worried if I do sell it to somebody (even if I listed it as a "Banned" xbox on craigslist or wherever) it could be traced back to me even though I'm not the one that's doing anything illegal to it (i.e. swapping the guts out and returning it to a store as I have heard stories like such on Afterdawn that some people are planning on doing). I am afraid of using my HDD & my Gamer ID tag on the newly bought xbox because it may be linked (paired) with the Console ID of the Banned Xbox. I'm just wondering if I'd be responsible for illegal actions of somebody else; get caught and be thrown in jail for something I didn't commit. I just don't know if M$ will trace my registered info of the banned xbox back to me. Or another possibility they'd see my banned xbox's HDD (which i'd be using on my new unbanned xbox) and use the XB Live Gamertag's credit card information to trace back to my address as the person responsible for what happens to the "sold" banned xbox.

Concern 2:
I guess there's really no way of converting a banned box to an unbanned box to continue playing backed up games "offline", does that neccessary mean I'll have to buy another brand new xbox and mod it and keep it an "offline" xbox?
For some reason, I thought I read somewhere, that people have done that trick of cloning console IDs as a method of salvaging a "banned" xbox (HDD lock & corrupted Gamer Profile). I was hoping there's a better solution to not having to buy a new xbox and be able to do something with my banned xbox as I am not looking for a solution to unban my xbox and have it go back on XB Live. (Which I am aware somebody is currently working really hard on doing)

hmmm I don't know, I wouldn't expect anyone doing such an idiotic thing (try to get parts of a banned console back to a store in a recently bought console O_o). Anyway, I would expect the store/M$ track the guy who brought it there. You usually have to leave a name when you want something exchanged, don't you? At least it's like this here in Germany.

concern2: you can get rid of the hdd lock by manipulating the internal nand storage of the xbox. Then you can use it as an offline box without having to buy a new one. But that's really difficult and I cannot help you with that. Maybe you can find a tutorial how to build the required hardware to dump the nand, manipulate it and flash it back to the box.

I think you can also flash a nand from another box to the banned one which makes it more or less a copy of an unbanned box (if that really works), but I'm not sure.

Hi, just to post an update: I was wrong, you CAN actually clone a console (with ID and stuff) to UNBAN it. But this requires you to do some difficult stuff. I just copy&paste a thread from another forum:

what you need:

your 8955 live console + cpu key
a 2nd unbanned console
nandpro b + flash cable
xell loader
degraded
1888 fs
robinsod's flashtool

process:

use nandpro and dump nand from unbanned console.
flash xell and use jtag hack to obtain cpu key.
use flashtool to extract file system.

dump nand from 8955 console.
use flashtool to patch nand dump with kv.bin from unbanned console.
save patched file (patched_kv.bin).

open degraded + 1888 fs.
create 1888 downgrader image (downgrader.bin) from your patched_kv.bin file.

flash downgrader.bin to 8955 console.
attach hdd + ethernet cable and boot console.

connect to live and update to 8955 dashboard.

console is now fully working and unbanned!
