I just got my modded wii that can play backup games. I want to play online (with mario kart) but I am worried if I accept the user agreement (under the internet option) it my ruin my console. Am I safe to accept?

Can they detect burnt games? Also what is this on the user agreement if you have something moddified it can damage it?

No, they cant tell at all.

The warning on the ELU is there for 2 reasons. First, it scares newbies like you and makes some people less likely to pirate games. And second it covers their collective butts so that if someone breaks their softmodded wii they can't blame nintendo for it.

Not only can nintendo not detect if you're modded, but they cant even do anything about it if they did find out. There is no system in place for banning a console from online play.

And lots of people have messed up their consoles, but in almost every case it is because the person was mucking with something that they shouldnt have. Almost never from trying to update and I've never even heard anyone try to claim that playing online damaged anything.

I have read a few claims of users being banned for cheating (don't know if this was true). But never have I heard anyone getting banned because of a softmod or hardmod.

So as of now they have not took action against modded systems. In the future this could change. But as always you take the risk when modifying any type of gaming console.

UPDATE: HERE is an actual error code that you get supposedly if you get banned from WiFi.

Even when someone is banned for cheating, the ban is linked to their friend code, not the console.
