Can they detect burnt games? Also what is this on the user agreement if you have something moddified it can damage it?

The user agreement is pretty much a scare tactic.

Just ignore it.

As for detecting if your Wii is modded. Maybe they can maybe they can't. I just know they have never done anything about it as of yet. But as to any gaming console. You take the risk if you mod it.
