I lost patience for the so called "ixtreme" and read of people flashing with 1.4 non stealth and not getting banned. So i updated a stock xbox with the latest updates, And flashed a benQ with 1.61, Connected the harddrive from my Banned console on the same network and once again saw "conected to xbox live"
Been online for about a week and havent seen any threads about this on AD so i feel i have to make one. I would encourage anyone with a virgin box to try this but i am NOT responsible if you get banned. 1.61 does stealth checks so it ensures security online (secure as possible) and avoid more user error.
This leads me to believe the "update" only checks your fw/response once, and as long as you have a stock drive at the time, i believe you are then safe on xbox live.
"This console has been banned from Xbox LIVE for violating terms of service, Yada yada yada..."

Ive been online daily since mid november, updated first then flashed. 1.61 samsung drive.

IMHO I dont think that the firmware response what the sole reason for the ban, so I dont think its safe until new firmware is released.

I have been using 1.61 and abgx and been using 1.61 since about a week before mw2 came out... still up and running fine with a benq drive.

sorry, forgot to mention i play online every single day with mw2 no prob what so ever..but my profile is always hooked to live with everytime i sign in i never unhook the ethernet and only use my live profile to play.

I've got a couple of spare RROD boxes and I plan on trying to go online with one of them, the other one I'm going to attempt to JTAG hack. I think most people will be fine for now until the next ban wave hits.

I agree who knows when that will be .. never would be nice!! I think the ban was a ploy to sell more consoles since sales were down.

It might take a couple of months until you get banned, but I do believe that you're insta-fllagged when your NAND records the changes in the firmware's drive checks. I do think modded boxes with iXtreme will get banned.
There is a theory where if you flash a new console before it is turned on for first use, there NAND doesn't not catch you out, since there is no recorded changes, the same applies when you connect to LIVE. But that's all it is, just a theory.

I'll tell you something funny, i went to mod my old console and the video and audio went out after modding it, i think the video was on the brink since i didn't touch anything, although, when it went out i put it back to original configuration, then went and bought a new 360 never turned it on and modded it. That's the one that I am currently talking about.

I had a console that had been offline since May 2009. Though it was offline, I kept it updated (fw) and had the latest iX update on it (1.61). I used it mainly to play modded ISOs like GW2. After the bans, I decided to take it online. I updated to the newest live update with iX firmware flashed to the drive around mid November. I did NOT play any backups or originals online. I updated then took it offline, flashed stock firmware back to the drive, and have been playing legit MW2 since.

Plus, I'd say it puts a hole in the "Your 360 logs everything offline and then sends to M$ once you go online" theory after I played those modded ISOs.
Just wanted to make this clear for any readers... I'm not saying this is how it is. I'm simply giving my info and you can take it for what it is worth. :)

ok, i found out some interesting information last night, somone else originally modded my xbox and told me they put 1.61 on it, but when i am burning wave 4 games i keep getting play dvd, so i put one of the games i bought from them before i got into modding in abgx to find out the video padding doesnt' check out, but i have been playing online since november now!
If i am correct this would mean they patched the game to wave 3 to enable me to play it and i don't have 1.61??

Yes that's what it sounds like. I've read elsewhere that patching games down is a guaranteed ban, since the game CRC won't match the game database check that LIVE will perform.

well i got ahold of the guy who modded mine, he said i'm on liteon 1.51 would explain why i can't play wave 4 but i have been constantly connected to live with no problems, does this make sense and i know my newest shooter is patched down to wave 3 now // guess i got lucky so far...

This is kinda what iv been thinking about doing. I was gonna flash my new elite (thats already updated on live) to 1.61 and keep it offline until LT was available then flash it before i went back online. That way unless MS can detect previous firmware or game history it wouldnt be flagged. As far as im aware it seems like they just ran a program for a month or so to read any firmware as a console came online, hence the people playing now that are unbanned.

This is just all the more reason to tell team jungle or whoever is playing games to go shove LT up their ___ .

yeah, you will be fine untill the next ban wave mate, afaict there wont be any random bans unless theres somthing wrong with the game youre playing, i.e. incorrectly patched, playing very early etc.

No, no, not at all. Updates have nothuing to do with the firmware checks, the drive firmware responds differently to the stock's behaviour. The NAND in the xbox records the difference in drive response and this is sent to microsoft (or so the theory goes)
Most of the information regarding Microsoft's method of detection is purely speculation and there is little to no solid evidence.

The update having something to do with the wave was just my first guess considering if you update stock, then flash, your fine (for now). No one really does know but we can all speculate like you said and draw a (fairly) accurate conclusion.
