After some info guys. Ive never been on Live before but want to go on Live soon. Running Ixtreme 1.6. Bought my console second hand so I'm not sure if the games that have been played have been stealth patched.
I want to update xbox to latest firmware then upgrade to LT.
Will I get banned if previous games were not stealthed. Or how can I avoid getting banned?
Before updating your system, check the system's kernel version. If it is 7371 or below, do not upgrade it as it can potentially be hombrew/JTAG hacked and there is worth much more if you do not update it.
If the kernel is a version after that, or if you just don't care about how awesome homebrew is, you can then flash the drive back to stock firmware and then update your system through Live or through an update USB/DVD.
Just so you know, there is chance that the 360 might be flagged for banning already, and as soon as you connect you will be banned and the console will be 'crippled'. This means that you won't be able to swap your hard drive between your banned and other, unbanned, 360s. It also means that you won't be able to install games to the hard drive. The chance of this happening is pretty great if the 360 had been on Live at all in the months leading up to the last big ban wave, beginning in November 2009.
If the system isn't banned, you should help make sure that it stays that way by only running fully legit backup games. This basically means only using games that were ripped using an 0800 firmware flashed DVD drive. Drives that use this firmware, and all 360 DVD drives are capable, produce SS 'v2', which results in more secure discs. I highly, highly recommended paying careful attention to this aspect of playing backup games.

Thanks for reply. My dash is over 8000 so no jtag for me. Is there a way I can format my hard drive before I go on live so if I had any saves of non stealth games they would be erased from memory and limiting my chances of being flagged / banned?

No, this information is stored somewhere else on the xbox so formatting the hard drive wont do any good. If the xbox has stored the info, there is not way AFAIK to remove.
You can "Clear system cache" in the system setting (don't know how off of the top of my head, so you'll need to search it) and supposedly this gets rid of some stuff. Nobody really knows, though.
