if you played an unsafe copy and you are flagged, flashing back will do you no good. then you are already flagged. so as long as you didn't play an unsafe copy, you should be able to update with no ban.
but
since no one knows for sure how you get banned (can a flashed fw be detected by the dashboard or not and how does this work), you always run a (small?) risk of getting banned updating a flashed console.
but updating a flagged console will get you banned for sure.

Yes, because you don't know if you've been flagged or not. If you've been flagged, it's too late to do anything about it. But in case you haven't been flagged, do your re-flash, as it would be best. Then all you can do is wait and see.
