Sorry if this question sounds dumb but, I have read pretty much the majority of the threads dealing with possible reasons why some Xbox users concoles/accounts were banned. I never came across anyone who mentioned whether or not there subscription was paid via the $8 a month or the M$ prepaid card. To some I know this might not mean anything, but if I were M$ I would keep the ones who pay the $8 a month vs the prepaid ones due to the fact they already got your money. Any thoughts?

no, once you get banned you can get some of you $$ back from your live subscription.

MS makes more money from game sales (licensing) than from monthly/yearly LIVE subscriptions. So the type of LIVE subscription has nothing to do with whether you get banned or not.

And your question was asked a number of times in the past bannings.

You want to be 100% safe; buy a console for backups and a console for LIVE.
