No, you shouldn't get banned at all. My console is still perfectly fine. :)

I had a quick question:

Do I run the risk of being banned if I transfer the profiles and save data from my old 20gb HD, which comes off a cracked box, to a new, uncracked 250gb slim? The old, cracked box was never banned, as I never went onto live with that console, but I likely played for a time without the latest ixtreme firmware when it was updated.
