It was not a SCOTUS ruling. It was an exception to the DMCA granted by the Librarian of Congress. There is also an exemption for video games.

That being said, the exceptions granted are rather specific and cannot be extrapolated to another platform. The exemption for phones, for instance, does not apply to the iPad despite it sharing the same OS as the iPhone, per the Librarian. Such an exemption would have to be addressed in 2013

...So you need to have a hacked device in order to get your specific device added to the list of devices that are legal to hack?

That sounds just insane enough to believe.

There is a bypass for those that want to use your Playstation on PSN while still on firmware 3.55:

Just do the following:

1) Go to Network Settings.

2) Internet Connection Settings.

3) Setting Method: Custom.

4) Pick your connection.

5) Choose Manual Settings.

6) When you get to IP Address Setting, choose Manual.

7) You should already have the fields filled in from the current connection, scroll to Primary DNS.

8) Input as Primary DNS: 67.202.81.137

9) Input as Secondary DNS: 67.202.81.137

10) Then do everything else Auto until it completes the set-up process.

11) You can choose to Test Connection, but it doesn't matter.

12) Go to Sign In...Not sure how long this work around will be valid though.
