Microsoft has updated the Xbox Live terms of use to prevent customers from filing lawsuits against the company in the United States. so what happens if you refuse and dont update. will new games not work because they require the update? is this something only in america or also over here in europe?

It depends on where you live...but since the few exempt countries are a very small part of the Microsoft client base, they are not terribly worried I am sure.

They are just doing this because they realize that Sony got away with it. Injustice anywhere is injustice everywhere.
