Apple wants injunctions on Samsung products, Samsung responds

article published on 24 August, 2012

After winning a major victory against its top rival, Apple has announced it expects to file for a sales injunction against Samsung and their devices within the week. The judge in the case has set September 20th as the hearing date on the proposed injunction, if Apple does in fact go through with it. Samsung responded to the verdict, in which Apple was awarded $1.05 billion: Today's ... [ read the full article ]

I think it was a BS call, I've looked at both sides arguments and some of the evidence provided, and frankly there was too much a gray line to pick either or, but it was hardly Apple's win either, definitely $1 billion is too much. It's like another set of American jury voted for their American products. The fact they took no time to decide the case, as if it was Apple's win all along shows just how shallow the jury was.

Now we can expect their tech devices to go up world wide to offshoot that billion and likely file an appeal, if one can be granted.

Talk about forum shopping. Apple have lost this ridiculous lawsuit in every other jurisdiction they have tried it e.g. Germany and Australia. The result this time round may be due to the jury being selected from the 'silicon valley' population.
Who ever heard of an IP claim being argued on the basis "that both devices have rounded corners"? That was apple's main contention. Forget about what software was loaded into the cases and/or that the two devices were running software which Samsung owns the IP of.
Two can play that game and if this insane decision which apple pr flacks have been indundating my journos with for the last 36 hours or so, is allowed to stand, Samsung will retaliate.
That means dragging apple through the Koream courts and winning an even larger payout from apple.
What are you doing apple? It is us; the consumer that foots the bill for your egregious vanity lawsuits, worst of all is the contempt that apple demonstrates towards their customer base.

These law suits are saying "At Apple we don't trust you make your own purchasing choices, so we are going to use the courts to force you into buying our products."
Why? Don't you have faith in your products at apple? If they are good and priced correctly they will sell without strong arming the competition or the customers.
That is it. I've had enough. My first home computer purchase was an apple 2D way back in the 1970's and I've bought a big range of their products since, but I will not be dictated to by greedy little twats who treat the justice system as if it is just another arm of their monster corp.

How can I boycott them when I haven't bought any of their over-priced, under-built, over-restrictive, and incompatible crap since the Apple IIE? About the only thing I can do (and have been doing) is to stop buying all music from any artist that makes an exclusive release on iTunes.

I will say this...even if apple strongarms and bribes every jury and judge to the point that no one else can make a phone, TV, or computer, I won't buy from Apple. If that happens I'll hold out with my old tech, I'll build my own with parts from their manufacturers, I might even hire meth-heads to steal the stuff...but I won't f**king buy ANYTHING from Apple.

It almost makes me want to be a christian...that way, I would at least have the satisfaction of knowing that Steve Jobs is burning in eternal flame.

This seems to be the American way. My neighbor wants to sue me because my dog got loose , charged him and nipped at his ankle. He knows that if I go to court the chance that he may get money is high because these judges really don't give a damn. They just want to clear the calender.
The U.S Court system sucks. It allows or anybody to go in there and make frivolous claims and whoever sounds the best, not makes the best argument, wins the case. The judges have triple screen setups and on 2 of the screens you will see twitter and youtube playing. The 3rd might be stocks or CNN. I speak from experience I am a court officer.

The judge didn't make the decision, it was the jury. After all, the judge would have been hard-pressed to agree that Apple owns the rounded rectangle if he was looking at a set of three of them.

The jurors are called randomly from general populace without requiring to have an IQ above 80, be financially sound ( hopefully less susceptible to bribes), be able to do simple sums of 4 numbers of 4 digits.

In this case they should have been sequestered from the very moment of being selected and held totally incommunicado.
