@Larrylje no im not talking about the Wii's im talking about the ps2's. i sent in a ps2 to get and i guess it got seized. i was informed i would get it back befre 60 days. im really oissed and shocked this happened. You guys make it seem that they were only Wii's when they were after everything. i guess this is the real deal i think they killed modding.

First off I am not a dumb ass I know it was more then Wii systems that where seized. The reason I assumed everyone was talking about Wii systems being seized in this thread is because this is the frickin Wii forum.

Secondly if you would have used punctuation in your first post and actually typed something that we could understand...

You even made a reference to Nintendo being stupid (I think that is what you where trying to say). So I wonder why I thought you where talking about a Wii system. What would Nintendo have to do with your PS2 being seized?

I didn't know that having a mod chip was illegal. I just thought it was illegal to pirate copyrighted material that you didn't own or sell copied items. My wii was out being modded so I guess that I am out. The only reason I wanted it modded was to protect my games from being scratched from my 2 kids. These things cost way too much money. I would keep the original safe and let them play the backup. Since it is legal to have 1 backup of an original that you own, but it is pointless because you cant use it unless you have a way to play it. I am flipping out because I do not want to be fined or jail over some dumb games since they now have my wii and name and address if the place mine was sent to was busted and confiscated . I am just trying to protect what is mine. . Just because you have a chip doesnt mean you are using it for illegal purposes.Does anyone know if they are comming after the people who were have their system modded trying to say they are just trying to play copied games w/o paying for them

Doesn't matter what purpose you give as why you are modding it. The fact is USA law states it is against the law to use hardware or software that circumvents copy protection.

Even tho the fair use act says you have the right to make a backup of your media in order to do that you will need a Modchip or some sort of program to use the backup at that time you will be breaking the law.

There is always a chance they could go after you but how would we know if they will or won't?

I was just bringing to your attention why I thought you where talking about a Wii system.

Plus it just wasn't Nintendo that supported the raids. M$ and Play Station both supported it as well.

to the best of my knowledge and the articles ive read nintendo and MS supported nintendo more than MS.ive heard nothing about playstation. but thse cimpanies should know is that modding actually brings them sales. the reason the ps2 is still selling so much is because it's so easy to mod. man i just hope i get my ps2 back mod or no mod perferably modded. i was planning to get a crystal chip. the main bios only runs homebrew so they shouldn't deem it illegal man im so nervous.

Has anyone had any experience with the Canadian-based(e.g. Toronto, etc.) modchip sellers/installers? Seems like everyone who is getting targetted and who's had their websites shut down are all only in the United States. It also seems like everyone who is still anxiously awaiting the return of their modded Wiis are from the US.

Any word/speculation on whether Canada will be targeted soon or are they going to be immune for awhile? I'm not sure how the DCMA applies to Canada in general. Although it seems like as a rule of thumb, it's probably better to lie low/not send your Wii to be modded unless you are willing to risk the possibility that the place will get raided and that you never get your Wii back.

check out this guy, he runs a reasonably priced modding service in canada, and looks reputable. He got a warning letter from Nintendo asking him to basically shut down his site, and he has a full rebuttal ready to keep his mod service running:

The DMCA basically states that any hardware that can be used, or help in the use to bypass protections is illegal in the US.


So therefore... Your computer is now illegal. That dvd drive in it? illegal. The Tivo you are watching tv on at home.. completely and utterly illegal. Your Ipod or other mp3 player? Holy crap thats illegal. VHS systems... illegal. Internet connections.... well you can possibly download stuff, so they are illegal. Let's just look at a list of other things that may be illegal according to the extremely vaguely written DMCA... Tvs, VCRs, DVD&CD burners, the wii itself since with modifications can dump games, SD cards since it can be dumped to, mod chips, bios mods, hmm... look around your room/house, I am sure you can find about 20 more things.

BTW, the DMCA is currently under scrutiny by the supreme court, and they are looking in to if it is even legal. Essentially, the DMCA was written extremely vaguely and therefore people are using it to interpret however they want.

Drats ur absolutely right. the dmca is vague and that gives the rich companies like nintendo ms and sony to manipulate it any way they want. hopefully the modchip resellers tell them that in court and they win the case and everything goes back to normal. to the best of my knowledge thats how it went in the UK sony tried to sue they lost and everything went back to normal i actually think this happened more than once in the UK and they emphasize over there htat modchips are illegal.

Got my WiiKey from Canada bout 2 weeks ago with no problem...

It did "disapear" from the tracking system for a day or two. Basically they told me and the tracking number showed me that it would be at my house in Saturday, and it showed up on Tuesday.

Could just be hold ups in the USPS or Canadian Post, didn't think of anything until it was mentioned earlier.

Ordered a wii chrome case & R4 DS Slot-1 Solution 2 days before the raid And can't get a response from modchipstore.com
Does anyone know a contact route besides the websites interface.

And if the modchipstore.com was one of the targets hit

This happened to me aswell. I orded swap magic and they said all pending orders were refunded and mine was shipped. 5 days later, ir was supposed to come. But it didn't so I emailed them and they almost never reply. and they said i got refunded. but i thought mine was shipped. this sucks ass.

Seriously, George Bush isn't responsible for all the bullshit in the country. I highly doubt he signed the order to raid mod chip installers.

Well maybe ill buy it there then. and ill get the fliptop at xbox clear. unless the government tries to take that too.
