Hi, I've been a member since about November 2002. I came to this site to learn more about how to install a modchip into my PS2...i eventually didn't want to take the risk of blowing up my PS2, so I talked to a few of the other afterdawn members and people were saying good things about a member called SUPLEH2 (who is now banned)

I sent him my PS2 in January and received it back 2 weeks later. There were problems with my PS2 so he told me to send it back to him so he could see what the problem was. It is now 3 months later and I have not received my PS2 back. He claims that the post office always closes before he gets a chance to send it. And he claims that he only comes in contact with 'one other person' so he doesn't have any friends that can send it for him. Do you guys know what i can do?

I am pretty sure that I have been scammed and I'm hoping the law can help me out. I have his address and his phone number. This guy is soooo frustrating! Whenever I message him asking where my PS2 is, he acts like I'm some pest bothering him! I am a man of great patience, but i can only take so much.

I've tried complaining and seeking help about him in the PS2 Forum, where a lot of his customers post messages, but the moderators keep deleting my posts because they are not "appropriate" I suppose.

If anyone can help me out, I'd greatly appreciate it.

No, he lives far away...which is a good thing, cause if he lived close by, I not only would grab my PS2 back, I'd bring a baseball bat.

It is difficult if there wasn't a solid writen contract. But if you know his/her name and address you can post internet warnings.

Since it's been 3 months, I told him to email me and update me on the status of my PS2. He said sure...but never did that. So I started emailing him almost every day. He would never respond to my emails. So finally I told him how shitty it is of him to be keeping my PS2 so long and he finally responded saying "you better get off your high horse before you regret it" What kinda business is he running?? Who threatens their customers??

Anyways, his main excuse for not sending it to me was that the post office always closed before he got out of work. So I told him to send it via Fed-Ex, which is open until 8:30. I know he is home then, so he should have no excuse. He hasn't responded to my email...

Some thing I cannot get my head around:

He is running a business, SO BY DEFINITION, he must be receiving items, and ALSO sending items back.

Sounds like a cowboy (forgive the pun)

I am from the UK, I had something similar happen to me with a car stereo, after 3 months I had no come back whatsoever.

I dont think, there is much you can do.

Personally I think, he has either majorly knackered it OR sold it on.

What I would suggest, which I cannot suggest here - would be damaging (ie something to do with the sport item you mentioned and an evening stroll)

Do you have anything called /or similar to trading standards, as I am sure they would be interested.

Is there anyway that the law could be on my side? No, I didn't have any written contract or anything, but we've contacted mainly through email, all which I have saved.

I have his name,phone number, and his address. I believe I still have the receipt I got after buying my PS2...maybe there is a serial number on it proving that it is mine.

Could I just call the police of his city and tell them that he has stolen my PS2 and have them drive to his house?

Or can I sue him in small-claims court?

I know there are several other Afterdawn members that have done business with Supleh2, so please share any information that might be helpful. I am getting so frustrated and stressed out over this. I just want my friggin PS2 back. If any of you have any advice, please let me know. I'm desperate.

If I was in your position, I would print off ALL the emails/contacts that you have had with this joker, also note WHEN you sent it etc etc.

Take that info to the police and see what they say.

Based upon their response it may be feasible to contact someone within small claims, and see how it could be progressed.

I would definately be peeved with this guy and would explore all legal routes known, cos as time goes by it may become more difficult to obtain a result.

That is all I can really say, but I think you need to act now and rattle his cage.

Maybe a registered letter from a lawyer(attorney) may just do the trick. (don't know how much they may charge?)

thanks for the advice. thats exactly what I am doing. I just printed out a big stack of his emails and have all my receipts from the post office. Wish me luck.

I know that you used to be able to get a solicitor in the UK to send a letter (1 only) for a one off fee of approx £5. May be worth checking out.

If you have the e-mails, with the person`s address and the comment that they will fix the playstation. Then you do have a contract. This counts in the USA. Definitely print it out, DO NOT MODIFIY it in any way!! As long as you have something with this person saying that they will fix it, then you are good. Also being in the USA you are good, sorry to say but you guys in the USA have sued someone for selling hot coffee when asked for hot coffee without a warning on it for being hot.
How did your Police chat go?
What I meant by the internet, was just post a warning to everyone with his name address ete.

I WOULD warn others about Supleh2, but most of his customers find his info from the Afterdawn PS2 forum, and any message I write regarding Supleh gets removed in a day.

i'd call the cops in his city and give them the info that you have (address, etc.) then say that when you were trying to get your stuff back, he made death threats against you (off your high horse or you'll regret it). with this info, by law, the police have to investigate it. if you can provide them with your PS2 serial number, they will actually take all the PS2's in his possesion while the whole thing is under investigation. then contact sony and inform them of banditbackups.com (supluh's site), plus give them his name and address and all that stuff so they will put the heat on him. then find every gay porn website you can find and sign his email address up for mailinig lists, pretty soon his life will be hell and he'll be begging you to take your PS2 (if the cops dont hand it to you). but the very first thing i would do is file a complaint at your local courthouse and sue him, he'll get a summons that he has to appear in court where you live, not georgia, that right there may be enough to get your system back, then you can drop the case.

I haven't contacted the cops YET, I wrote Supleh one last chance to do the right thing before the law was involved. Of course, he didn't bother replying. This is what I wrote:

Dear Mr. Tatum,
After consulting with my family lawyer about the recent circumstances involving the return of my repaired Sony Playstation2 system which I sent to you on 01/08/03. After reviewing all of the emails and conversations we've had, it was suggested to me that I send you one last certified letter to discuss the final result. If I do not receive my repaired merchandise as promised by you on 06/02/03 I will be forced to follow through with a claim in a local court.

I wish that this problem can be solved amicably However, if I do not receive my merchandise within a two week time periods I will be forced to follow through. I thank you in advance for your cooperation in this important matter.

I wrote to him again, updating him on my current address. And again, no response. Here's what I wrote:

If you have already sent it, that's okay, with mail forwarding, I should get it eventually.

If you have not sent and do not plan sending it back anytime soon, I'll gladly accept a check (mailed to the address above) covering my PS2 ($199), my Magic3.1 modchip ($70), and a refund of your installation service charge. (I believe it was $70...but I'll check my records)

If u hav good reasons for havin ur ps2 sent of to be chipped and u hav proof that the ps2 is urs then there should be no reason the law wont be on ur side.

I still have the original box that I bought my PS2 in and possibly the receipt. Is there information on the box or receipt that can prove that the PS2 is mine?

Is the Serial Number on the box and or reciept? Mayb stores only get certain numbers and he would of had to go to where u live to get it? If u hav any proof like i said i dont see why u cant get him.

Two weeks ago, I sent www.banditbackups.com until June 2nd, 2003 to send my PS2 back to me or else I will file a report against them. June 2nd is this Monday. As the deadline approaches, FINALLY, after 2 weeks of silence, he responded back to me saying that he will send my PS2 ON June 2nd.

...I'll believe it when I see it...
