xbox 360 premium edtion with vga/hd hook up to my dell 20.1 inch widescreen lcd.

I'll take this down WHEN micro$oft decides to stop being lazy and make the capcom fighting games backwards compatible with the 360 dammit!!!

However, he was the one who registered the User ID with Yahoo. Therefore, he violated Yahoo's TOS. Not only that, the auction was listed in a deceptive manner using sentence fragments and incorrect use of punctuation. And even after it is deciphered, the auction is claiming to sell the e-mail address not the password. The buyer can totally get the money back from the auction.
All it would take is a good lawyer, but that depends on the buyer.
Let's analyze the description:

The first line tells the buyer what he/she is getting. This is misleading, however, when you look at the next line:

It should really be "Official 60 GB Premium Playstation 3 E-mail, Official.PS3dealer001@yahoo.com!". Notice that the sentence was separated two ways; through the improper use of an exlamation mark and a line break "<br>". Also, is the email address an "official" PS3 e-mail address?? I think and official e-mail address would be @playstation.com or a domain where Sony has given permission for them to be an official PS3 dealer, not @yahoo.com. Yahoo owns Yahoo, not an official PS3 dealer. Was the seller an Official PS3 dealer?? If so, then the e-mail would be correct, but he is still selling an e-mail address that does not belong to him/her.
Quote: This next-gen console is nearly impossible to get!
False statement and also improper use of pronoun. "This" makes reference not only to the "next-gen console" but also the previous statement. The previous statement is "E-mail! Official.PS3dealer001@yahoo.com" according to how it was written. This translates to "[You] e-mail OfficialPS3dealer001@yahoo.com". That was a command, not a next-gen console. So therefore, the sentence was making reference to the command for someone to e-mail officialPS3dealer001@yahoo.com and a PS3 system at the same time. However, the way it was written, the consumer would asssume that "This" referred to the item being auctioned, which in the remainder of the sentence was revealed to be the "next-gen console" referring to a PS3.

Nothing really wrong with this sentence although it could be argued that e-mailing a password is not considered shipping.
Quote: Boost sales by up to 50% Not console being sold. E-mail password will be sent upon purchase.
The first sentence has no meaning. Boost sales up to 50% not console being sold. In reality, this should be 2 sentences: "Boost sales up to 50%." & "The console is not being sold." However, "The console is not being sold" is still incorrect as it does not fit where it is written. Again it is misleading and can be translated to "Boost sales up to 50% of consoles not being sold". Which is what the seller wanted? No one can say.

It is still unclear as to what the "IT" refers to, but other than that, nothing is wrong here.
Quote: On Nov-20-06 at 18:53:24 PST, seller added the following information:
Advertise your 60GB Premium PS3 with this perfect highly effective e-mail address!
This is finally a well constructed sentence, but it is not part of the description. Also, it is not clear what "this e-mail address" is. The e-mail written in the description was hyperlinked meaning that you can click on it and compose an e-mail. Also, the way it was written "Email! OfficialPS3dealer001@yahoo.com" is a command.
Now, on ebay, there is a way that you can list electronically transmitted items. The seller failed to list in this manner. Also, it was never clearly stated that "The PS3 console is not being offered for auction". The first line of the description should have made it clear what was being sold like "This auction is for the e-mail address "OfficialPS3dealer001@yahoo.com". Then with the followup, "You are not bidding on an actual PS3 console."
If the buyer were to take this to small claims court, they would most likely get all the money back less court fees.

Or the buyer could just not pay, get a negative feedback, and keep the 600 bucks. The seller is obviously a crook.

Theres no way this guys getting paid. Ebay has policies for things/events like this. But still people have to be more careful.

The problem is the guy made a auction that at first glance seemed to be selling a PS3 w/60 Gb hard-drive. So like nearly all auctions now the bidding went into the high hundreds of dollars. But upon closer examination of the auction you can see that through deceiptful wording/pictures the winner of (with a top bid of like $680) didn'y win a PS3 they won a email address that would help them sell PS3's.

IMHO This is Fruad as it is listed under "video game consoles" This is not a console,it is an e-mail address. Delibertly listed under video game consoles to defraud people looking to quickly bid on a ps3. Yes let the buyer beware but it wouldnt break my heart if someone put some serious hurt on this lister who directly/indirectly is giving ebay sellers a bad name. p.o.s.
