Re: Unauthorized Use of NBC Universal Properties
Notice ID: 14-6934223
21 Aug 2006 06:39:40 GMT

Dear Sir or Madam:

Please be advised that NBC Universal and/or its subsidiary and affiliated
companies (collectively, NBC Universal) are the owners of exclusive rights
protected under copyright law and other intellectual property rights in
many motion pictures and television programs, including the title(s)
listed below (the NBC Universal Properties). NBC Universal diligently
enforces its rights in its motion pictures.

It has come to our attention that Optimum Online (Cablevision Systems) is
the service provider for the IP address listed below, from which
unauthorized copying and distribution (downloading, uploading, file
serving, file "swapping" or other similar activities) of the NBC Universal
Property or Properties listed below, or portion(s) thereof, is taking
place. We believe that the Internet access of the user engaging in this
infringement is provided by Optimum Online (Cablevision Systems) or a
downstream service provider who purchases this connectivity from Optimum
Online (Cablevision Systems).

This unauthorized copying and distribution constitutes copyright
infringement under Section 106 of the U.S. Copyright Act. Depending upon
the type of service Optimum Online (Cablevision Systems) is providing to
this IP address, it may have legal and/or equitable liability if it does
not expeditiously remove or disable access to the motion picture(s) listed
below, or if it fails to implement a policy that provides for termination
of subscribers who are repeat infringers (see 17 U.S.C. 512).

Despite the above, NBC Universal believes that the entire Internet
community benefits when these matters are resolved cooperatively. We urge
you to take immediate action to stop this infringing activity and inform
us of the results of your actions. We appreciate your efforts toward this
common goal.

The undersigned has a good faith belief that use of the NBC Universal
Property or Properties in the manner described herein is not authorized by
NBC Universal, its agent or the law. The information contained in this
notification is accurate. Under penalty of perjury, the undersigned is
authorized to act on behalf of NBC Universal with respect to this matter.

Please be advised that this letter is not intended to be a complete
statement of the facts or law as they may pertain to this matter or of NBC
Universal's positions, rights or remedies, legal or equitable, all of
which are specifically reserved.

Please send us a prompt response indicating the actions you have takento
resolve this matter, making sure to reference the Notice ID number above
in your response.

I wouldnt recommend that, or it is admitting you did something illegal. I would visit the phoenix labs website, go to the forums, and speak to fox.....he is an expert in this field. There are a few arguments for this type of event, and he would be able to help you out. Regardless, I wouldnt reply with saying that the content has been removed, as it is proof that you illegaly downloaded the movie.

Agreed. Deny, deny, deny. I have a little brother who uses this PC, I have no idea what you're talking about, etc. It's their word against yours, if there's no wrong doing, there's no cause for legal action.

LMAO, your joking right? Ever hear of the MPAA??? Not good man, time to do a refresh course on P2P. Your not "100%" no matter what you do! And of course you dont admit you download, that would be pretty damn stupid.

Yeah there's no real cohesive anti-piracy group against games, mainly music and movies.

There is no GROUP advocating for games and software, but the individual companies pay BayTSP and others to watch for them too. Symantec, Adobe, all the big names do it.

I also made a big post in a thread called "I got bit" or something like that--search for it, it's chock-full-o-goodness.

Yeah but they do that with everything. Every private BT tracker will have people monitoring your IP no matter what you download. Universities, companies, government agencies, that's everywhere. Basically if you're paranoid about downloading copyrighted stuff, don't do it!!!

I know that game piracy isn't policed nearly as harshly as music and movies, at least not in America.

I should mention that this could be the isp being cheap NOT necessarily an mpaa/riaa thing. They do it because p2p constrains the service which costs them money. They say "unlimited" but they count on you not using to much bandwidth.

In all reality ALL anti-piracy is about is money,The rich getting richer while we get broke paying $20 for a dvd.Deny it like the others said.get rid of it and use ccleaner(free) to remove tracks from things like media player at the very least...Sorry about your luck as well, hope you the best.

CCleanrer is great but does not cover tracks. Only linux based tools will totally wipe your HDD. "Shreding" files such as using Mcafee Shredder or CCleaner is great for documents and such, but if your comp was seized, forensic analysis will exploit the traces left by these progs.

@stang you may be right as you know more about it then me, but ccleaner has a settings tab under options with a secure deletion option. When it does delete things it logs it in such a way that isn't specific to the actual file itself(e.g. it doesn't say deleted "godfather" it gives no names)

So where am I going wrong? How would they know it was the godfather if it doesn't say that?

Yeah, thats what i meant by a 7 stage pass. For all intensive purposes it is secure, but for something like this thread, it wont save your ass. There are hidden files that record these deletions, and id have to talk to admin to where these are. I asked how to delete these, and was told its extremely hard to do, and each time you reformat it makes it that much harder to erase.

Think of linux based deletion as 100 passes, and it does it instantaneously. I am not a computer techie, but I have been told by a admin/coder/programmer at XS how it works. If your HDD is seized due to RIAA/MPAA intervention, they have frensic software per se that will trace anything you delete/ blah blah. Linux is foreign to Windows operating system, and the manner that data is deleted makes it 100% gone, forever. There is a prog named "G partition" that is just that, a linux deletion tool.

Sorry I cant explain it better....you know where to go though if you want a 100% explanation though ty :)

The NSA says data is really deleted after it's been overwritten after 7x data rewrites, and here's what a data rewrite is:

1. writing 0 then 1, alternatively across the entire disc surface
2. Writing 1 then 0, alternatively, across the entire disc surface
3. Writing random 0's and 1's across the entire disc surface.
4. Writing all 0's
5. Writing all 1's.

That is generally considered to be 1 true pass...now do it 7 times to scrub the data.

Think of it like this, your disc is like a plate of food. You put some food on the plate at a picka-nick and eat a little, and then you see brownies so you throw away what's on your plate. (delete it.) Your operating system (brain) tells you that you don't want to put a brownie on top of the place you had Aunt Bessie's macaroni salad, so you put it next to it. Now there's a hole. Sure, the macaroni salad isn't there, but it's pretty obvious what WAS there, right? Now you take a few bites of your brownie and you decide to get a piece of pie, do you put it where the salad was? Nope! You put it in a new place. Then you eat it, and go back for more brownies! Do you put it next to your other brownies? No, becuase there used to be something there, so you put it in a new clean spot.

Now you're plate is full and you want some deviled eggs. Now you HAVE to put them where the macaroni salad was. So you do, but there's still a little gap---between the eggs and the brownies, and what does it look like was there? Macaroni salad! So now you want a burger, but it won't fit in the gap btw your eggs and brownies, so you have to put it where the pie was...

Get it? When winders deletes something it just erases the pointers regarding where that file is, it doesn't do anything w/ the data. Then the next time it writes data, it automatically writes it PAST the last used block of hdd. Rinse/repeat until you're out of disc space or it reaches some predefined level of fragmentation, and THEN it starts filling in the gaps. Or it might put a piece of a file in this gap, and the rest of it over there...that's called fragmenttation and it makes you go sloooooooooooooooooooooow.

In linux, it actually removes the footprint of the file immediately and then rewrites the next block of data right on top of the old one.

There, that's my overly long explaination for the day.

Ok thanks both of you for taking the time to explain it.I read it all:)

Tommelee that was a great analogy I had to read it 3 times, but Now I see what you mean.Lol?

*edit*btw when I said log I meant those little pieces of data that the ccleaner stores(where ever) as far as what it deleted(like what you guys were talking about).I guess you could call it a stamp or whatever the hell as well.
