ESA is providing this letter of notification to make @@@@@ Internet Ltd aware that the IP Address identified below is using the services and systems of @@@@@ Internet Ltd to infringe the exclusive copyright
and other rights of one or more ESA members. This notice is
addressed to you as the agent designated by @@@@@ Internet Ltd to receive notifications of claimed infringement.

Through the Berne Convention and other international treaties covering intellectual property rights, ESA believes that its members? rights in such entertainment software products are entitled to the full protection of the intellectual property law as well as other relevant laws of your country.

Based on the information at its disposal on 14 Oct 2007 06:58:59 GMT, ESA has a good faith belief that the subscriber using the IP address
**-***-***-*** is infringing the copyright rights of one or more ESA members by copying and distributing unauthorized copies of game products (through peer-to-peer or similar software/services), in violation of applicable copyright laws, through internet access that @@@@@ Internet Ltd provides directly to the **-***-***-*** or through a downstream provider that purchases this access for **-***-***-***.

Such copies, titles, game-related listings/references/descriptions, depictions, and material that is the subject of infringing activities are hereinafter referred to as "Infringing Material.?

Given this infringing activity by **-***-***-***, the ESA urges @@@@@ Internet Ltd to cooperate with its efforts to protect the intellectual property rights of its members companies and immediately do the

1. Notify the account holder of the Infringing Material.

He didn't download it from Blackcats though. You always put yourself at risk when you use public torrents. That's why the the rare occasions I get something from a public torrent I delete the torrent as soon my download finishes. It's not like you have to worry about hit and runs on a public tracker.

Being that I'm not familiar with the cons and pros of using private torrents vs. public torrents, I have a question.
If an ESA spy joined black cats and got access to use their torrents, would they be able to identify identities (IP addresses) the same way as if they were using a public tracker?

I would think so raysuave, as mediadefender did just that with OiNK.
Slyck: OiNK infiltrated.

I wonder also what information is kept on members in the OiNK servers that were seized the other day.
Hopefully not incriminating.
But private trackers do not seem so safe to me.

Not because it helps other people get the same file you just got
But you are glad the people you got it from did not hit and run.

After I got a letter from my ISP from downloading The Grudge in 2005 using bittorrent, I stopped messing with P2P programs out of shear fear. I don't want to be the one to get made an example out of. I only use mIRC and newsgroups now, primarily newgroups because of the constant high speed connection.
