Compatible? Decent gaming rig for the price?

Ok, So far I have one build under my belt for my own PC and am very happy with it, there are some things I would do different but hey.. thats experience for ya.
My issue is though my cousin recently came up to me saying he wanted to buy some garbage pre-built PC from a computer store around here, I told him for half the price i could make him a PC twice as good. Hopefully I didn't put my foot in my mouth. The following is a build I put together on newegg just a few minutes ago. I am almost positive that its compatible, please double check if you could? Also I think for what the build is its a fairly decent price. He wants it mostly for gaming, and I think shooting for running oblivion on high would be a good goal.
Anyway What do you all think?
Please feel free to give any opinion on the products, as well as making adjustments to the build. I am making this for a family member not myself anymore so its a little more important to me.

P.S. I realize that this build does not have a HDD, or a CD-ROM I spoke with him about it and he said he was going to include his older ones with this build.
However I would imagine his HDD is non SATA, would he still be able to use it?

Well I have to agree with some of the parts but, price is somewhat of an issue.. the budget is roughly 350USD, The PSU is nice its what I have in my build right now. I realize that the vid card you chose would be ideal, but I think that goes a little over the mark. Is there anything close to what that one can do for cheaper?

Ok, I hate to bug you about this.. but this computer is going to be for a 15 year old rather immature child, and as far as overclocking goes which the article spoke of briefly.. I don't trust him even for a second, and my own personal experience isn't enough to do it very well at all and feel secure about it.
Also 350 is the limit on the PC, he doesn't have a job and his birthday was recently so he asked me to build him something with every penny he had.
Thanks again, lastly maybe oblivion is too high as requirements goes I'm sure if he could play wow well with decently high video options he would be as giddy as a school boy. Hope that helps, Thanks.

ok thank you very much for your assistance, and I thought the open box was risky.. Thats why I came to use guys for the opinion on your second build. Yet again you never leave me hanging. I'll post and tell you how everything goes.

The only issue I have on the mobo is that is a micro.. that won't cause any issues will it? Also I don't think it will be an issue on this board but I have read on some cards where they can block a PCI slot, I read over the reviews and couldn't find any issues with that.

MicroATX boards are fine, you just don't get as many bells and whistles with them. If you use a single slot graphics card (which most cheap ones are) then you won't have the issue of any PCI slots being blocked.
