I have a lot of MPEG 2 files that are 720x480 128k/sec AC3 at 23 fps What is the best program to convert them to a DVD without having to re-encode them?

Try DVD Flick.
Under 'Project Settings' > 'Video' > 'Advanced' there is a setting to copy compliant mpeg-2 without encoding.
