Does the ATI HD 3870 support both direct x 10 and direct x 10.1? Also, is there much of a difference between both directx versions and will the direct x 10.1 help improve performance and graphics in crysis?

Directx10.1 smooths out a few things in DX10, not much, but the important thing is that it re-enables Anti-Aliasing, a feature DX10 can't do (the game will either crash or simply ignore the fact that you turned AA on). That's a big advantage in my mind. I hate jagged looking games.

You mean DX9 games? Yes. All DX10 and above graphics cards can render Directx9 fine.

That's about the only Vista rumour that isn't true. However, I usually recommend people avoid using Vista if at all possible, it's a nasty OS compared to XP, far slower and believe it or not lacking in several features XP offers.
