Hmm, has anyone been banned modding a console straight out of the box without changing settings or playing anything on Xbox live.. I've read somewhere that it's possible that M-soft takes a fingerprint of the console once you get on Live. Once that fingerprint changes say by a firmware mod then red flags go up,then could it be that there is no check made prior to the hacks made so m-soft thinks everything is ok. I don't know just a thought.....

navsav, I can tomorrow as it is a long holiday weekend i will also have Saturday, Sunday and Monday to play some. But 9PM PST is a bit late for us EST time zones when i have to work tomorrow. But if you do happen to see me on when you get on send me a message.

elusiv1, i think there is a lot more to it then that. It could be one of the factors but my sources tell me that there are multiple tests that they can/are doing to the consoles that have nothing to do with the firmware but can tell if you are using a back up disc by things like the stealth sectors being in a different place, or that the drive can answer requests from info from MS quicker when it has been modded then when it is stock and so on.

Thanks for the info steimy, i figured there was more to it then that. But hey at least we are trying to find solutions to the problem rather then bitch about why we got banned all the time.

yeah, tomorrow night i have no time limit navsav. So we can get a game up for sure, although i may have to boot someone from my room, LOL. They fill up really quick. Let me know about what time (EST if possible) and i will make sure i start a game with a few private slots so i can send an invite without your spot being taken. I have really only played Terrorist Hunt and story modes so everything else will be pretty new to me.

I wonder if Microsoft have a leg to stand on with the bans, as far as I am aware modifying a console is not illegal so are they in a position to ban accounts based purely on that fact? Also when you buy credit for xbox live does it state they hold the right to stop your ability to use the service if the wish?

I dont actually know the answers to those questions as I havent checked properly but if they dont have the right or state they have the right then if if was contested they could have problems.

They're banning the console not your account. If you buy another console you can continue to use XBox live. So they're only preventing you from using the service with a modded console.

i believe MS showed alot of mercy towards how they handled the situation. you can still play your backups and your console still functions you just cannot get on live. It could be alot worse to all these people bitching about how they got screwed when they broke the terms of agreement.
Im running an MS28 with x5.3 and still have not been banned. I patch the SS's for all my games in xbox backup creator. Ive read where the fw patches the backup to be stealth but if you didnt do this if MS checks the disc couldnt it take the fw a different time to respond rather than already stealth patching to disc?

ms showed no more compassion than they did with bans on the original xbox. they banned you from xbox live but you can still play backups.

its a shame people are comlaining. you took the risk, now reap the rewards. i think micosoft have made a brillaint business move. it will caus more people to buy their console, right when they're loosing out to wiis.

also, more people will buy games. so more software sales.

ofcourse, some wont care about the ban and still downlaod games and play offline, but thats no loss, seeing as they woudl have been doing it anyway...but they will get money from the rest.

also, to the people who are moving to a ps3, and saying MS wont get their money, its not liek you gave them money after you bought their console, so they are not loosing money on that either.

to the poepl that accept they got banned for the risk. thank you. you lot are level headed.

REAM, Yes i would agree with most of that. Modders should know the risk they take and accept the consequences that come with it. Anyone who owned or knew anything about the original Xbox would already have known that eventually a modded console would get banned from Xbox Live. They should also know that there is a good chance that down the road there will be some sort of softmod that will get around it.

As far as MS not losing money, well that part would be untrue. Because they will. Not that a company that large will really fell hurt about it though. They could have had a better plan. Like for instance not banning your Live account completely, just the gaming part. This would have still given you access to the marketplace to buy movies, arcade games, and themes. But i am sure that all of these people who are so addicted to Live that they are willing to go out and buy a new console will make up for that. Unless of course they are dumb enough to buy one second hand, Like from Ebay. I'll bet that there are hundreds of modded consoles on there being sold as brand new or never modded. Too many people figured out the trick of opening it and saving the security sticker. And you would have no way at all to tell other than trying to load up a back up, which of course would risk getting your "new" console banned as well.

No one should buy a used 360 now unless you don't mind getting a banned one. I would never sell a banned or modded console to someone without telling them or do the ol' switcharoo. I never want to screw over the little guy. The karma will come back to you. What I found really hilarious was I was in Microcenter (a computer/electronics chain) and they had at least 10 open box 360s in there for 20% off yesterday. They didn't have any 2 weeks ago.

Yeah but was it a Samsung or Hitachi? It's not definite, but it's becoming evident a stealth flashed Samsung only using stealth backups is safe for now. I'm bought a new MS-25 Samsung and it's been running strong on Live for 4 days now playing only stealth patched backups.
