I sent emails to 3 sellers whose description said "not modded" asking if it had been modded prior to the auction. Think about it... "not modded" and "never modded" are completely different.
I got one reply which said it was modded before but it has it's original firmware now only because it's against Ebay policy to sell modded consoles (ya right, I'm sure it's also banned from Live). Another email said it was never modded. And I never heard back from the third guy. Wouldn't doubt that one's banned, too.

yes i agree that there may be a link between the hdd and console but that does not make it a fact that a unmodded console will be banned from a hdd. all it is is speculation that makes a bad situation seem much worse.
i also agree that there is to much damn crying over what happened,
we all new from the start that it would happen sooner or later and we were blessed that it lasted this long.it seems every other post here is a complaint about it... shut up already, either sell your banned xbox and buy a ps3 or wii or suck it up and buy another xbox!!!

Same here, all stealth patched, xtreme 5.3 on a MS28 and I'm banned. Probably because I have achievements before the retail date.

thats a bitch aint it.i never played games before the retail date all i did was play backups online and i got banned the last time i ever played online was with a GRAW 2 backup.

Yup that's what I'm thinking. I'll even go as far as to say some of these pre-release games showing up online may have been traps my MS. Many of them haven't been stealth patched.

anyone found anything new in the details of how the bans are coming? im still not banned, and im getting a little pissed that i cant get banned. i have called MS everyday asking them about it and they keep saying that my console appears to be banned.

Still no ban for me either. Been playing Forza 2 offline and thought as I've got achievements on a game that hasn't been released yet then maybe this would flag me up.
Attempting to play Forza 2 online would probably be suicide so I'll skip that.
After the first wave of bannings things do seem to have gone quiet. Of course at the end of the day no one still really knows how people are getting banned and how come some of us haven't. I've read plenty of theories but for me most of it (if not all) is still speculation.

HEY guys i work in the music biz n 1 of the things i do is work with microsoft and sony putting artist songs in there games, well i didn't want a microsoft employee to know i mod there console it's bad biz because of my job, any who while talking to my friend over at ms i told him my friend got ban it was good for him etc, he asked me did he go online before he mod i said yes well he told me that's why. He honestly didnt tell me if u mod out of the box u will be safe but i assume. if any1 mod stright out of box with a sammy n new firmware, no play retail game before release date, n stay the hell away from halo u should be fine, if u did all this and ur still ban i believe like myself u were online playing retail games before release date. graw2 for me

That theory is BS. My brother bought a 360. Never opened the box. I opened it, found a MS28 drive and flashed it with xtreme 5.2a
He only played ONCE online against me in Fight Night Round 3 and got banned. The whole theory of flashing out of box is WRONG. And yes, the damn game was stealth patched. Please stop spreading all kinds of "insider knowledge" because the only knowledge on this subject you NEED to have is the kind you FIND out firsthand.

Man I'm telling you that shit insn't right. I flashed my bro's 360 with MY 360 power source. I did all this already and he has been banned. I'd bet my REP on AD that these are not safeguards to banning.

well ps2 thats what he told me and memnock been up n running for 5 days and yes memnock the game must be stealth patch something i didn't do
ps2 without the anger can u please explain what happen did u straight from the box flash ur drive sammy firmware 5.3 because if u didnt everything right maybe its the game ? wasnet properly stealth it can be anything ps2 but honestly people are up n running all my frinds are fine with doing everything i said

I don't want to discount what happened to your bro, but it's possible there is more a history to that 360 than you know about. Plus it would be good to have every single detail about the flashing and the only backup that he played.

i for 1 deserve to get ban honestly i didn't pay any attention to if the game was stealth patch or not, i played games before the retail date, i flashed my drive 2wice i believe with the same power source and also i believe not sure ps2 dont kill me i heard flashing more than 1 is a no no

Well catsee I have to say, I meet all the criteria you have mentioned above and thus far I am not banned either. My firmware was upgraded long before I went on XBL with it. Never been on line with a pre release title. There is a chance I have screwed things up for myself cause I've now played Forza 2 offline then went online with Rainbow 6. If they're scanning people's achievements MS will see my Forza 2 stuff before release. Although I may have played Crackdown (offline) prior to the official release, I can't remember.
For me so far the info you have provided rings true but I just knew someone would flame you for it.
