I just put an ad on C-list 2 days ago coincidentally, and after reading this, I took down the ad. It's scary to hear about this. I guess I'll just stick to the "word of mouth" business.
I can still do x-clamps and dvd repairs though :)
sum1 already had stevedawg and stevedawg85 is longer than 10 chars :(

Interesting. All my business comes from craigslist. Mod or repair. I don't see how a mod is illegal if you aren't selling them games. After all, you're allowed to make backups of games you own. Why else do they sell burners for? and what about this part?
"While Mr. Crippen may have been aiding software piracy, the extreme penalties the charges carry and the fact that he is not being charged for pirating software, but rather for merely modifying hardware he legally purchased seems highly questionable."
There goes the thought that you can do anything to something you own.

Well, a few things...
- If the charges are indeed based on modifying hardware, and not actually pirating the software, this is probably nothing more than a minor charge, but the Publicity it received could have been encouraged by M$ and the big boys to discourage Piracy, so people like ourselves would read this and be dissuaded.
- Does no one else think it's kinda funny how the article randomly throws out a claim that piracy is dangerous to ones health "they can also pose significant health and safety risks to consumers" and had no backing evidence, just random allegations?...I dunno this made about as much a blip on my radar, as the Napster scare did so many years ago...regardless, like someone else said, I would definitely avoid online postings, and stick to word of mouth...

Is no one else using Craigslist? Where does it state that you are not allowed to mod a box? I thought you were allowed to have backups of your own games?

the DMCA states you cannot circumvent DRM. which is what flashing the drive does. it sounds like this guy is being charged with all possible charges hardware and software.
the article states he violated the DMCA.

In the article the guy who got poppped even said, "I do this so that you can play backups only, if you want to pirate, I can't help you." He still got busted.
It doesn't matter if you sell games or not as far as the DMCA is concerned. You can still be charged just for the simple act of bypassing any sort of digital restriction. Ie; modifying an Xbox drive.
That being said, there are tons of people who do this every day and only one or two get caught. Just be smart about it, like the title says. I honestly wouldn't be doing any mail order stuff, for profit or for free, like some of the guys around here do, though. To total strangers, that may be dangerous.

This is one of the reasons why I don't care to advertise like that, plus I don't want people coming to my place ect ect. But as others have said, it's against MS's ToS to use custom firmware as it's their code but changed and blah blah.
And like others, I think the guy was advertising and I bet he was doing some good biz.
