seriously, completely unnecessary, barely anyone whom has gotten banned is complaining about being banned, everyone knew the risks, and have accepted it, so your comment is both offensive and ridiculous.

Do I own my console, or is it Microsoft's console that I am only using under license? And if I own my console, is it even possible for Microsoft to gather information from my property without first getting my prior consent without invading my privacy? And finally - have I given this consent by way of the Terms Of Service?
I think a large portion of the "testimonials" on this thread/board are from inside industry hacks who are tasked with creating confusion and panic. Of the people I know personally who have modified xBox 360 consoles, I do not know a SINGLE PERSON personally who has been banned from the LIVE service. Yet you read here and it would give one the impression that the banned percentage is very very high.

Just got banned :-( feels like ive broken up with a girlfriend or something LOL i do miss live but hey i knew the risks and took my chances.
At least I can still use it as a media centre and connect it to my home network for streaming purposes around the house!
P.S If i play pirated games on my main gamer profile, then use it on a new legit 360, will it increase my chances of getting banned? (Achievement data etc)

Do you really believe that to be true? So if someone were to sneak some language into the TOS for a given product or service about how they can come into your home and sniff your underwear to find out what you've been eating, and you blindly sign off and agree to the TOS, does that give them the right to come into your home and sniff your underpants? Just because they put the language into the TOS, does that make it legal?

Depends....most people dont read any agreements, and not just for xbox live. I know I have a habbit of just clickin' the "I Agree" button without really reading everything.

Well, I managed to dodge the banhammer for quite a few days. Just got off of work and I took out my HDD to check the status codes from the connection in my system settings and I wasn't even able to check the codes to see 190D, before I even had the option it chimed in saying "this consol has been banned for violating terms of blah blah blah"...so I am really glad I've been looking on here to see all the helpful tidbits posted by others...well when people aren't too busy getting off to flaming anyways. I was thinking that I might be saved since I have spent a couple hundred bucks on marketplace buying maps and tv shows, stuff like that. But never-the-less Microshaft has given me exactly that...they knew that MW2 was so close I could taste it...looks like I will be using my school loan to buy me a nifty new box with that game...Bill Gates...you win again.

so here is a strange issue that may or may not be related..
So as i mentioned i got the ban earlier today on my modded console.. since i got the ban i said wtf and decided to play cod mw2. Loaded up my main gamer profile and played a level etc.
Now i put the hd back on my main legit system and it doesnt detect the profile. i checked memory and it says corrupted profile. I switched back to my modded system and the profile loads fine..
strange.. i guess i can recover on my main console but i guess this stops achievements from being saved on backup games

Yep thats part of the ban...
Hard Drive installs are now disabled on the banned console. This means any disk-based games you have will no longer play off of the hard drive. If you attempt to play a game, it will tell you that it was installed on a different 360 and needs to be deleted/installed again. When you delete the game and attempt to install it, you are given a message telling you that it is not supported. There is no way to fix this, that functionality is simply gone from the banned 360.
Your Gamertag may be corrupted. This does not mean your gamertag has been banned, you can recover it using any live-capable 360, however ANY ACHIVEMENTS YOU HAVE EARNED SINCE BEING BANNED WILL BE LOST. Your gamertag will be corrupted EVERY SINGLE TIME it is used on a banned console. This means you cannot use your banned console to play backups offline just to get achievements - it wont work, the second you put your profile back on a good 360, it will be corrupted and all progress lost. There is no way around this.

The hard drive itself is left untouched - you can place it in another 360, even an unbanned one, and it will still work just fine. You do NOT need to reformat it to regain any kind of functionality. Any installed games will need to be reinstalled for the console you want to play them on. This is normal behaviour and happens when swapping HDDs on unbanned/legit 360's.
Thanks for the info.. but i was not trying to play a game of the HD. I was simply trying to log into my profile on my legit system, it just doesnt appear anymore on the dashboard. The profile appears in the system memory as "corrupt". It loads fine on the banned system though.. :(

yea i guess the banned system is useless now.. I guess ill keep it to play offline games with a different profile or memory card..
I dont want to risk losing my gamertag. So do MS usually just ban the console and not the gamertag?

In ban waves like this, yes - they just ban the console. If you get a new console, you can recover your gamertag and you'll be fine.

I have a question, I did a search and skimmed through some of the threads. But is there anyone that got banned with a spoofed drive? And if so what spoof? Hitachi to benq ect

A friend of mine got banned and he didn't have any games on his HD. He didn't even know how to do it (I told him he was retarded). I thought about that too. I still think that M$ messed with the stealth patching with abgx. They would have had to do it a long time ago. I rip all my own games (never dl) and I have lots of people who are banned. I haven't used abgx in almost a year.
I know everyone thinks there must be another way they're doing it but I'm really going towards believing it is the FW checks.
P.S. Still not banned!....yet.

alright im not good with this whole modding/ban thing....cod mw2 is now out....im dieing to play it, im not banned yet...should i just keep my system off until shit gets figured out or just go and play...

I dont know....I have used agbx for a while now. My cousin swears that he always make sure a game is verified before playing. So I grabbed a few of his back ups and checked them. Out of the 5 copies I had 2 were verified and "all green" in agbx. I asked him what level he sets his agbx to, to verify? And the lil asshole (Hes 11) told me he just goes to the website to see if its been verified!?!?!

Chances are that if youve been flagged, you are already banned. There is really no hiding from it now. Only way to check is to get online. Just do it with retails or Verified rips

Well I went to walmart and did the swaparoo with a new xbox..I flashed the firmware to 1.61. As soon as I logged on using the defualt silver account I was banned.
