It is simple. The DMCA says it is against the law to circumvent copy protection. Hacked firmware circumvents copy protection. Maybe no one has been arrested for it or maybe there has but it hasn't been publicized. It doesn't change what the DMCA says.

ok homies this thread has become retarded...i am someone who got caught by mpaa for labeling and in the process of seizing items, they came across the modded 360 because they found bootleg games, now ms did not come after me as im just one guy but they clearly explained how it was illegal and my 360 was confiscated because of the illegal firmware on it...i know from firsthand experience so lets end this thread already.
