If the console has been seized as evidence in a DMCA case then I really wouldn't expect it back any time soon. As I'm sure you know, criminal proceedings can take a long time to come to fruition. Months if not years, depending on all the different factors involved.

If it were me that had my console seized then I would cut my losses and buy a new one. If/when the seized console was returned I'd sell it on eBay. I know you'll lose some money that way but at least you'll have a console to play.

Also, I know this goes without saying but if you are going to buy a new Wii to replace your old one that got confiscated I would get one sooner rather than later as they are expecting a big shortage still come holiday season (and you know how early people start shopping for them).

Wanted to add my own personal input/experience from mod chip sellers. I tracked down someone who got rave reviews located in Toronto Canada and sent them my system even AFTER the raid happened on 8/1 (I think I sent it out a week ago on 8/7)...I took a chance because of all the problems going on, so I knew my Wii could potentially be seized. However, the guy is EXCELLENT, has had great reviews/excellent communication, just received my system yesterday and I'm getting my whole system shipped back to me with Wiikey installed today.

I still have to receive it, but if it comes back great (it comes back with a 60 day warranty according to him) I will let y'all know. His website does not show the Wii install service anymore as a precaution I think (even though I don't think Canada sellers/installers have been raided yet), but I think he will still be doing them although he'll be scaling back after September for personal reasons.

Point being, if you look hard enough and are willing to order out of country you can still possibly get a chip and even a whole installation service done! I paid about $84 for everything (plus shipping of course)

It's cool that they are still selling swap magic and being careful about it. I may need to buy a few of copies for myself and friends just in case supplies run out.

Yeah you should. It even comes with a slide card. I dunno if its my CD swap magic or not, but they always get a disc read error when I put it in -__-. but it'll work if you ejct it and put it back in.

No offense,but I wonder who is stupid enough to buy them for that price.Talk about ripping a person off that is horrible in my opinion.I think the raids on the modchip installers are not going to get anywhere.I remember when the DMS team was going to get sued for producing the chip for the PS2.It is funny,because a modchip is useless without the flash for it.If you look at all the modchip distributors/installers they sell or install the chips without the flash,so what exactly can they do to them.I'm just stating the obvious though,a modchip can't do anything without the flash that makes it function.If they sell the chips without the flash or install them without the flash they can't get in trouble right.

It not ripping someone off unless there's fake bidding going on. It's an auction and people bid what they want. If they are dumb enough to pay that much well that's on them. All swap magic have been selling for pretty high since the raids on ebay. I'm talking around $50 just for the discs.

I think the topic was meant for the actual modchip distributors/installers.Swap Magic is a boot disk for the PS2,and was a cheap method instead of getting a modchip.It is very effective and I still think that is a ripping someone off no matter how dumb they are on the ebay auction site.The last time I checked the price of the discs on ebay are 4 times the original price.I'm not saying I would buy them if they cost that much,just saying it is a ripoff regardless how you look at it.

I was just thinking that yojacks said that he was informed he'd have his wii back within 60 days, im wondering if that might apply to me as well. Also, i'm hoping that it might be decided that my wii isn't revelant evidence, as it was only being repaired and not modded. You seem knowledgeable on the subject, you don't think I'll get slapped with any legal action, do you?

No. If you just submitted your Wii for repairs you haven't broken any laws.

My Wii was seized also, but I've never received an email like that. I wonder if I will. That's kinda neat that they emailed you though. Are you sure it's a legit email?

I think it depends on what kind of repair it is,such as a regular repair you won't get in trouble.If it is a modchip install repair then they can withhold the system until the investigation ends.

Yes, but (I dont know if i made this clear) there was a modchip in it, and that was why it was being repaired. Does the response that I havent broken any laws still stand?

At first i thought it was a scam and that they stole my wii, but i think its pretty legit. I haven't tried contacting that number though, so im not certain... but especially seeing as how the raids definitely did take place, i think it is.

From what has been seen and known in the past if you sent out a wii you have a slim to none chance of ever reciving it back the thing about it is mentioned in every story heading "Raid" when the feds went in they took everything! meaning their Wii's other consoles, their computers, TV's, DVD players Stereos ect. That is why this is so serious and why the FEDS now have a ton of Suits against them is because they left these people with nothing, I really feel bad for these guys for allot of them this was their living. But for all those concerned about not getting their mods anymore don't worry this is just the US and their haste to enforce the DMCA they have no weight or bearing on other countries such as Canada whos goverment couldn't care less and as for individual users? yeah right good luck on that one see how well punishing the individual consumer worked for the RIAA? so I sympathise for those who had their wiis on the way to be modified in the states cause most likely they are gone now.

Not that I saw the raids coming, but I always felt if you had to get a console modded it's best find someone local, because stuff and can happen.

lets just say one of those places that got nailed would have been local to me. so dunno about that theory. all depends how big you are, i guess. i' m sure there are a few small ones that slipped through the cracks.

there are a lot of decent local small time modders who's installs are quality just not as pretty as thew big guys who got raided such as norcalmods and teammodders. but this on website in san diego CA didn't get raided (sdmods.com) im surprised but then again nobody talks about this site on forums or he doesn't advertise himself. hopefully by posting him here he doesn't get raided but that's highly unlikely.this should be the last of raids for a while since the gov't would be scrutinized if they wasted more money on modchips and game modifying.
