There's a thread on Xbox-Scene where a handful of people are saying similar things. One guy can be logged into Live just fine and he can play XBLA games or chat to friends, but any time he fires up a disc based game he gets the ban message and is signed out, but then he can sign right back in again as long as he doesn't try and play another game from disc. Only about 3 or 4 people posted to say similar things are happening to them though.

i got banned tonight =(...didnt play any pre-releases...my sis did put in borderlands for a couple mins but it was grabbed/burnt and verified well after the release date guess its not what i thought...hope like larry i log back in sometime and it says hey just kidding lol

Yes this happened to my mate, he told me last night that he was banned and now it lets him log back in today as if nothing had happened.

Same. Banned, and within 15 minutes, I was able to get back on live. I've tried everything to test it out. I can chat, view friends, download content, use netflix, and play multiplayer games. So strange.

Just sharing my pain with you guys....
MS just hitted me. I live in Brazil and have a Lite-on flashed with 1.6. I bought it on July.
Played like 10 to 20 backups.
All of they obtained through torrents.
All the games were stealthed according to the settings that can be found in this topic
After the ban wave started, I re-checked all the games. One of them got a bad game crc. So i removed the disk, and tried again. This time there were no problems.
Outside this games, there were two possibles causes.
1. an oblivion copy that was in russian. The game crc was damaged, but i was a noob and played anyway for about 2 minutes. Never touched it again.
2. an prototype copy. This was actually patched to work in firmwares <= 1.5. But my xbox did not even runned it. It game the "put this into a xbox" message.
NEVER played nothing before realease. Actually I usually waited about 1 month to play new games.
Played only about 2 days per week online.
Had just bought Live Gold.

Big post. But analysing my situatio, I WOULD say that they got me really trough firmware. Dont think that the bad rips I mentionned above were the reason.
Im actually not mad. I took the chances.
The only thing that worries me is not beeing able to install games. Altough I think there will be a hack way to revert that.

Well from what I have seen it seems they have detected the firmware. It doesn't stand to reason that every single person that claims that they only played properly ripped games and non early is lying. I wasn't banned as of a couple days ago, haven't got on there yet tonight.

Yeah I was banned. However after 10 minutes or so my cousin logged into his live account then i was able to log back on like normal i can boot up regular games haven't tried any backups though. I have also heard from someone that they were banned they unplugged their HDD plugged it back in and were able to log back on like normal.
Update:Banned again at 7:30 pm eastern last game i was playing was a retail cod5 copy and the games before that were street fighter 2 turbo hd remix and cod 4

I just got banned.
Either today or yesterday, as I was on live without issues on wednesday.
Have 1.6 iXtreme on a LiteOn.
Never played a wave 4 game.
Started playing borderlands about a week ago.
Sux because this xbox is only like a month old.
I've played rock band 2, batman, borderlands, beatles rock band, dynasty warriors 6, fabel 2 GOTY, the L4D2 demo, brutal legend on this one. All of them check out, except for L4D2, since that's not a full game.

I will comfirm that the ban is true and it has nothing to do with borderlands or any other game know why? BECAUSE I WAS BANNED! I do not even own the games in question and the last game I played was a retail copy of Rock Band about 4AM this morning.
If you read some post, Microsoft has implemented new thing now in the updates they are sending out that helps them detect if someone's console is modded. Yes the borderlands people as well as the Halo people were dead give a ways because they were playing the game early. There are a lot of games I played early and still was not banned. Honestly using the game is a cover up. There are so many people in the industry that gets these games early. I have an advanced copy of GH:Van Halen because of a deal that Activision offered if you bought GH5. So if they went around and shut down people just for games, they would have to shut down people who actually has the game legit!
The sad thing is once banned you will never be able to get that Xbox back online again. I have called MS and they said the same thing and then directed me to a FAQ www.xbox.com/consoleban which states the same thing.
Once again this ban is real and not fake! Just because you have not been banned yet, means absolutely nothing!!! This hammer will be long and continue until they get almost everyone they can.
The thing they are not looking at is how many people will go to the PS3, but they are not caring.
Just to give a heads up. Before this happened when I turned my Xbox on it did not want to start then I restarted it and it came on. After this I was banned today.
All that are still on be safe, but NEVER feel 100% secure!!!

GREAT question! I would like to know this as well, get stuff into perspective (by that i mean, now i can really worryyy! lol)...
I rip all my own games. Run ABGX on the ISO file , which, I was told isnt really neccasary. Then I burn and play fine without re-checking disc with ABGX. I am still good with no BAN. I have Lite-On drive, not sure what model #, it is the 2nd one that was released. I have Ix 1.6 on it.
Do you think M$ looks back on GT's that have had cosoles previously banned and pays closer attention to them? I was hit with the hammer last Nov and just went and bought another system

hey guys, i have a question. When I was trying to do a connection test on my xbox 360 to see if i was banned or not. a system update require message pops out and asked me if i want to update it. I am confused because on octomber 28th, I already updated my system. So what is this update for then? There is a new update that came after octomber 28th?

Well I was only lucky for a few hours. My brother called and said he was just banned so I checked again and I was banned again. Kind of weird that I got banned then unbanned then banned again. LOL

Came home after a long day of work to find out i was banned!

But whatever man, i mean thats the risk that we take when we do these things right?! lol
but anyway, I posted this on another thread, but, for me, i think the game that flagged me was Batman Arkham Asylum... I played all these games for over a month with no problem: Need for Speed Shift
Fable 2, Fallout 3, BlazeBlu, Resident Evil 5; all games INCLUDING Batman passed the ABGX test. HOWEVER, as soon as I put in Batman (yesterday), I was banned within about 13 hours... ho-lee crap, they work fast!

I have 2 customers that are banned. Both have lite-ons with ixtreme 1.6 and both have only played ripped, stealthed, and verified games (no torrents). None of the games have ever been played early. They were both playing Borderlands when it happened. Everything was done right. M$ is detecting the systems itself somehow....not through the games. Since there's some people who have not been banned (ie myself and other friends) who have the exact same setup and games as those who have been banned, I am going to venture a guess that M$ is somehow just checking the systems one at a time randomly....otherwise everyone would be banned by now. If the people I know got banned aren't safe then no one who's played backup games on live is. We took all the possible precautions. I've been doing this for a long time and this has happened several times before. I think they just let modders THINK they were safe for so long so that more people would get their 360's modded and, therefor, more people would have to buy new systems if they wanted to play the awesome games coming out soon. Holiday bonus anyone?

It's definately something else now - Have heard from a friend that his is banned (1.6 Benq, only played dirt 2 fully stealthed + checked). I've just had a 1.61 samsung banned, my lite-on on 1.6 is still working at the moment.
M$ must have a way to detect the custom firmware...

I only play my own ripped games and everyone I know plays the same ones. 2 friends have been banned. Everyone is using the 1.6 fw.

Here's what I think -
Microsoft is doing a random hardware integrity sweep on consoles (they can do this even if the console is off but not unplugged). I had a friend banned and the only thing he was using that didn't says MICROSOFT was a 3rd party mem card.
I myself had my console banned this morning (11/06/2009) ~10:00 am PST. I was playing a private 2-player co-op game on Borderlands with my friend. Both of us got our Xboxes at the SAME TIME, both of us had it modded with iXtreme 1.6 at the same time, by the same person, and both of us were using the same version of Borderlands that I had downloaded and stealth checked for both of us 4 days after it hit store shelves. It's the only non-store bought game that has been in my xbox in the last two weeks.
I believe that they are just doing a remote call to the xbox to spit out firmware numbers and banning anyone who doesn't check out, or returns bad info (as anything modded will do).
the only solution is to hook your xbox up to a computer and flash the BIOS with good info from a new xbox 360... as far as I know.

Great info in this thread guys. I especially appreciate the info regarding people who have played only home-made rips.
There does seem to be some new detection mechanism in place now that was not in place as of the previous ban wave last November.
Here is a theory -- we know that MS cannot DIRECTLY 'sniff' our firmware. Even for us to do it, we have to put the drive into vendor mode/Mode B/0x72 status. MS obviously does not do that, or else we would notice when our drives did not work.
However... one thing MS possibly could do is build firmware challenges into the dashboard itself. Rather than depending only on the backup games to challenge the firmware, MS could potentially have added sophisticated firmware challenges into the software that runs on the 360 at all times. In that way, MS could more easily detect hacked firmware and we could not establish a pattern based solely on what games were played.
Ideas or feedback on that, anyone knowledgeable?
$38 on new discs -- Check
$15 on burn after burn that showed as a DVD -- Check
$11 on new laser -- Check
$28 on new multimeter -- Check

P.S. I think they're using the new release games to base their search for consoles to scan.
IMO, This has to be getting done manually or something. An automatic detection method would be a lot more thorough. I've noticed, though, that Microsoft's ban sprees are always around this time of year...

Ok, I've read 100 forum pages of this now and can say now that there is only one logical explanation. M$ now has the ability to actually look at your system and see what firmware you're running, most likely from the new update. It doesn't really matter how. That means, that if your system has modded fw on it then you are most likely at risk of getting banned, regardless of how you made your games. If you were playing games online before they were released then you probably increased your risk (that's pretty stupid if you ask me). M$ programmers aren't idiots and we would be foolish to think this day would never come. M$ will continue banning people until the market balances again. By banning people they will lose money in game rentals, xbox live, costs for banning, and customers switching to PS3 and Wii. They will gain some money back from customers who buy new 360's and start buying games. At the point where the cost of the man power to ban people exceeds the additional revenue gained from their increase in game sales, they will withdraw their hammer. The fact that some people are getting unbanned shows that M$ doesn't have a solid system for doing this. They went through and banned a lot of people then had doubts and unbanned them. If you got unbanned please post your drive and FW info. Maybe there's a pattern there. Sorry for the long post. Bored at work. Hope this helps.
