Alrighty, so it seems confirmed that there's no risk of the update affecting firmware, and games are generally safe. Though I've seen a few reports regarding GOW2 and COD:WAW. I just want to clarify, that the people who are getting banned are those who were playing pre-released copies, not actualy retail backups. Is there something about the new games or were people just being stupid?

Ok my questions is we have determined that some leaked games and bad rips have been the causes of these bans. I downloaded Gears of War 2 when it was leaked, I also downloaded Fallout 3 when it was leaked. In order from being ban would it be a good idea for me to re-format my hard drive? Or can I just delete the data I have for these games? I think I will reformat my hard drive tonight so I can have a clean start with NXE.

doesn't matter if you erase the hard drive. it's the system itself that keeps logs of the games.

I've been playing GoW2 I patched using xdvdmulleter for about a week now. Updated to NXE today and nothing has changed. I'm not banned from Live and I can still play my backups and burns just fine. I still unplug my ethernet cord though when I play unpatched games like BK:N&B and Fable II. I also played Fable II about a week before it launched offline.
I have a Samsung MX28 with iXtreme 1.4.

Just wanted to share I have a Hitachi 059 with iextreme 1.4 i updated
and no problems here.I only play backups of the original games I own.I have never downloaded any game.Also played GOW 2 online after
update and still no problems.My friend who lives across the street
has a Hitachi 79.He just had his drive flashed and only owns three games.Halo "Original Game",NBA2K9 "backup copy" and Mortal Kombat vs. Dc Universe also "backup copy".he plays all three online and
got Banned today.When he went to update console was Banned.

I have an MS25 that I flashed a long time ago. I'm not sure on the firmware version though. I recall that it was newer than the 1.2 pdf tutorial I downloaded, so 1.3 or maybe even 1.4. I have never played a downloaded game, only legit copies and backups of those that I have made myself with a Kreon 162C and XBC. I don't run abgx or whatever, and have burnt a coaster or two. Logged into XBL tonight and installed the NXE, browsed XBL and played COD4 for about an hour. Logged back in a while later and everything still works. Will post an update if that changes. I am in Canada, if you think it makes a difference.

Well i for one have seen enough of the newb world...omglol741 if you're too lazy to read and actually contribute to the thread then don't even bother to come here. i was in the same boat as all you guys, me and my 2 mates went to someones house to get our 360's flashed to the 1.4 firmware, 2 of us survived the banning so far but the other got banned, the new update however has got nothing to do with banning at the min as i updated my yesterday and expected to see some form of banning code straight after the update but no all good so far as ive read that the only thing the new dashboard does with games is copy to the hard drive unless ive read a few bits wrong on the dashboard update.

in reply to yondon and to clarify a few things did your friend played mortal kombat before release date? did he ajust his system time to the actual release date before playing? the only things we can do to help prevent getting banned is dont play games at all online or offline before the release date (if you carnt wait buy a recon console and use that offline) there around 100gbp now price of two new games so its a bargin if you download your games run them through abx360 or dvd mulleter check them and autofix if there is a problem and avoid pre-release copies from the net i have 4 xboxes and 3 of them are online all with 1.4 ixtreme hitachi 79, samsung ms28 benq(1.41)ixtreme,and hitachi v59 (offline) by following these simple rules over the years i have never been banned although by brothers unmodded console got banned sunday i have checked it it is unmodded and he doesnt even play online really he just downloads the demos strange really, everyone who is afraid to go online incase they get banned might aswell as if you dont update you carnt play online anyway so you might aswell take the chance as you will still be in the same situation now as you will be and update and get banned atleast there is a chance if you try it would like to thank all of you for the info given so far and keep up the good work

Alright guys, this thread drifted a lot from banning to the new update but I just want to add my situation that may help with understanding the ban.
I have not been banned as of now.
I have had a flashed drive since last march and since then I have checked every single game with XDvdMulleter, (did autofix, never checked data). so according to that, I have been playing tons of games, but only those that check out with Xdvd.
Next, I have over 100 played games on my xbox, and a majority of them have 0 achievements, so I think that that theory kind of goes out the drain.
And lastly, I have never played a review copy, like I said every game was checked out on xdvd and if it doesn't check out I don't play it.
Oh and I have never played a single game before the release date.
In conclusion, me and my friend both hacked our boxes at the same time, and we play the same copies and neither have been banned. So I believe if you check your games with xdvd and don't play before the release date you should be safe.

Review copies check out just fine with Mulleter. That doesn't change the fact that it's highly possible for MS to detect them.

Right, I am aware of that, but I also know I've never played the seed4me releases and such, and I also try to mke sure I know its retail before I do play it, but there could still be a chance played a review copy without knowing it.

if you are using nxe then you can delete your achievments with a 0 score to help tidy up your profile a bit microsoft had updated there terms of use on live aswell maybe there is some more new crap to read maybe they included smoking while playing your xbox will get you banned now lol seriously canyone help me with my status code on my sisters machine the z line is afff-0018 rang xcrap live customer support and they said i was not banned and would ring me back within 24-48hrs i have tried all the usual tests unblocking the ports and direct plug to the modem and my isp isnt banning the port from there end.as it was working fine on monday on live

Ok I see this weekend as a final test because the Europe xbox celebrations are happening meaning a lot of people will be on live( because it will be free) and we will see if microsoft sends a ban wave. I just installed the NXE it is great haven't played any games yet though. I am going to try a verified working version of Gears of War 2. If I get banned from that one game I will let you know.

My box is flashed fresh (first time done 2 days ago) and I haven't played any "backups" etc... but I have played GOW2 online a lot.. still good.
My xbox live that is... GOW2 online is kinda lame.. takes forever to find games :(

Benq arcade flashed with ixtreme 1.4 about 3 months ago.
Played GoW2 after release date never online, as a matter of fact havent played any game on live yet. :) Updated to nxe yesterday, no ban yet. Hopefully wont soon, since my last hitachi got the banhammer last year. Ima just go with playing only originals on live and backups exclusive to offline like my boy does and he hasnt been banned for like 2 1/2 years. btw, he downloads his games off torrents.
Note: Man was this thread becoming a cluster ^&%&. Noobs flaming on crosses, Noobs not wanting to read!!!!! That guy was funny, " Oh No!!! I have to readdddddd!!!" lol Thats how it works in here dude READ, LIKE I JUST DID almost all 25 pages! Its worth it at the end.
