More than likely, it's a flashed Xbox 360.

Yes, you can update if you have the latest LT+ firmware flashed. If the latest LT+ is not already flashed you may need to re-flash your Xbox 360 with this latest firmware or the 360 won't read certain games (mainly Halo Reach, Black Ops, MW2).

Note: You have to update in order to play online.
