I am having a lot of trouble with my probe.

I am using a Serial to USB adapter and I keep getting the Bad Serial Data error.

I have checked my hardware using Hyperterminal and i get nothing although everything is setup correctly. I am getting power from a USB cable, however, once as the USB Cable has been plugged in, the com port cannot be opened. Any ideas?

Yes but I don't think you wanna build this probe (it's out of date).

Build this one instead:

It's the same thing as Xecuter's Probe 3.
Step 1: Just put a needle/safety pin/paper clip/etc on wire #5.
Step 2: Cut wire #6 and add a switch to it.
Step 3: Use any connectivity kit and start flashing. Use Jungle Flasher's Probe 3 section of the tutorial.
----------------> The LED is optional.

Here are a few examples example of one:

This is what I have done.

I have a 10 ohm resistor soldered to the base pin of the transistor. from the other side of the resistor it goes to the probe.
then I have the emitter soldered to pin 5 of the d-sub connector
the collector pin is soldered to pin 2 of the d-sub connector
I have a 1 ohm resistor also soldered to the 2 pin of the d-sub connector
after the 1 ohm resistor is my 5 volt power wire

does this sound correct?
