More or less if you system has shown you have played a lot of the 360 game library and it logs everytime you play a game at different times during the year. I also think that this runs deeper than the theory of early releases.
I mean playing a game weeks or a long while before it hits the shops is risky but as official release dates get near, it is well known that people get legit copies earlier and play them. i doubt MS would ban for this.
I hope they are not banning people for putting on their own HDDs as it seems a step too far.
Be interesting if one of the people with no flashed drive has actually replaced their HDD in this way and copped a ban for it.

NO theres no flaging for banning, 1 flag 2 flag 3 flag ban.
Your flaged, your flaged, comon sense says YES some people will have games before actual release dates (testers, devs etc) SO the legality of baning a console is BAD business, but if the sytem shows youris is modified, then your cought. 12x to 5x speeds down to using a chip or bad Stealth. But last I checked 1.3 and 1.4 protected u from playing BAD ss games? Then again theres THOSE who just HAD to have the new dashboard, why in the world would u do that.
