not to flame, but a coment like that shows why your a newbie,

NO theres no flaging for banning, 1 flag 2 flag 3 flag ban.
Your flaged, your flaged, comon sense says YES some people will have games before actual release dates (testers, devs etc) SO the legality of baning a console is BAD business, but if the sytem shows youris is modified, then your cought. 12x to 5x speeds down to using a chip or bad Stealth. But last I checked 1.3 and 1.4 protected u from playing BAD ss games? Then again theres THOSE who just HAD to have the new dashboard, why in the world would u do that.

You do not have the right to tell someone they're wrong or right. Nor do I, nor anyone when it comes to this subject. We are all theorizing on this subject, and I too have noticed the people who have been modded longer are the ones who are getting banned more often. I think it would easily have something to do with them causing more slip ups, and that building up against them. M$ looks and sees that Billy has played 4 bad games, had two system errors when the DVD drive couldn't be found (flashing process), and one game played before the release date. That person would much more likely get the ban hammer than Timmy, who has played one bad copy of a game, and one system DVD error.


Hopefully that cleared up my theory.

Correct me if im mistaken, those people who were decided it to apply the NXE update, as far as im aware after the update has been applied you wont be able to sign into Live untill the realease on the 19th. In order to get banned, you have to sign in to Live to be told that you the wrath of the ban hammer has been brought down on you, so if your not able to sign in, how are these people telling these people that they havnt been banned?

You can still do a network test.After you do it and of course it won't connect,you hit the Show more info,when you enter that blade you hit the Y button to See what your status is.And there will be the info.

Does anyone know what it reads if your banned using the NXE?Or do they put up a Big poster saying your Banned?

Thank you Valence, you said exactly what I was trying to get at. That's one logical theory that I could think of and it still doesn't say anything about how they can detect it, but it just says that people that are safe through this ban doesn't mean if they continue what they are doing won't be banned from the next one. It just slowly builds up and gives them enough reason to ban you.

Suppose M$ is looking at the timestamp on your gamesave on your HD. If that timestamp is < the release date of the game = banned. Too much coincidence that this is happening around the release of leaked GOW2 and COD5. Plus no banning since May of 07'. If they could detect a burned game directly, they would have done it a long time ago.

I also thing they are keeping a list of people who have signed in to other games on live and the update could search for gamesaves for other games at the same time. Ban those people over time = tough to figure out the pattern.

Delete your gamesaves for these pre-release games

Just a thought.

Also quite possibly, but I don't feel as Microsoft is this determined to ban some people. I feel like they'd be going by something much easier noticed, and much more concrete evidence. I doubt any ONE incident will get you banned.

OK now, if you happened to pop in a game that brought you to the "dissconnected from live" popup and just took it out and went no further, are you safe?

Or, if you didnt notice that you got disconnected and continued to play, are you at greater risk?

I signed in a little while ago just to check and still ok. So I checked all my saved game data and there was nothing from the "bad" game I tried. Do I still have to worry?

I haven't been banned and have a 0079 Hitachi with IXtreme 1.4. Were any 0079's banned because I haven't seen a single one. I think I may be in the clear since 0079s are so hard to mod.

Here's my deal.

NOT BANNED.
Benq 1.41
Played all the early releases when they came out. The review copies too.
Never online though, and never a disc in the drive when connecting to live.
Ethernet cable only plugged in when I want to go on live.
Only use live, silver account, for demos and updates.
Console had an issue and no matter what date I changed it too, it would always revert back to some date of 2006 at 4AM. Don't ask, I have no answers for that.

If I missed anything I'll update. But that's my deal and as I said, NOT BANNED....yet!

Edit: Console has been flashed for almost a year now. It's a refurb.

Hey, just been reading this thread and obviously there are a lot of variables as to what may have caused people to get banned.

Just wandering if there are any known solutions to getting back onto xbox live with a banned xbox apart from buying a new box? Would completely wiping your harddrive and putting it back to its original state then not playing ripped off games work as then you'd have no log on your harddrive showing that you'd played dodgy games??

If your console is banned...it is banned.

It has nothing to do with your HD.

They ban you by console ID..not your account. your console id has nothing to do with your HD.

i read on another site that someone had reflashed his box to the original state and replaced hd, and then rang ms to ask why he was banned he has put that he was saying he paid for his live and it is against comsumer act that they have cut it off when he has done nothing wrong!

further down the line he has put that he is now back online not sure if it will work but just thought id let you all no

My friend I have the same issue, about the time always going back to X date but I did noticed something, in my case it happens after I play one of the pre-release games (GOW2) if I play an original game it does not happen...weird huh

One more thing I update my console with the leaked NXE and so I can really tell if I am already banned or not or if I am even going to be able to go back online...time will tell.

Oh something l Will like to share I've created a new gamer tag and I when ahead and check most of my friend Id's that have been banned and I found that even thought they did not play any of the prereleased games online they did play them before time(offline achievements)In my case I have not been online for over a month and if I check my profile on the XBOX it shows all of the achievements I've got so far(including those from GOW2 dated 10/27/08)but since I have not been online I check there and it looks clean (it has not synchronize yet)so I am formatting the hard drive and saying bye bye to my current gamer tag.

I do believe is a bad Kreon rip (or one that was release prior time) along with information store in the memory of our XBOX that is given us away.

Now I am getting scared. Just got today my 360, and I am downloading GOW2. But the torrent I am downloading is dated prior than the release date.

Should I stop downloading that version, and wait for a backup created after the game was officially released?

For me, this game was released before time in order to track modded 360s, and it might have some sort of information in this one that will allow M$ to identify who is still using it.

I know you guys dont want to hear this, but its coming from me if that makes things any better. A close friend of mine that I MYSELF do all of his flashing burning ect. had his ACCOUNT BANNED, NOT HIS CONSOLE. He hasnt done anything wrong on xbl. he called me and was like wtf. He made a 1 month and was able to connect. they said the reason they banne dhis was terms of use or whatever. I did not want to believe it, but maybe that account banning thing wasnt a rumor. I am still good to go on live as of today. By they way me and his have the same isp and live 1 mile apart. Not that it matters but everything is a speculation.

My intention was not questioning anybody, not even creating a discussion. As can be seen in my previous comment, I say "for me", meaning, my personal opinion about that.

I read first few pages, and couldn't be bothered checking the rest so don't hate me if this has been said before - but has somebody suggested a deliberate leak with a specific demo or mod signature that is different to the release version of either cod5 or gow2? Has anybody compaired the latest release with the leaked one for differences?

I don't think they would be detecting the mod itself, it is far easier to "leak" a marked release and just log all people who log in with that copy... the studio wouldn't mind the leak either, since it helps their sales when the pirates are banned.

The timing is perfect though, these guys are very good... I like how they do it a week or so before the new update, had they done it during people would have clogged up all the support lines with calls about Live problems, then the legit red-ringers (inevitable for such a large update I think) wouldn't get through causing a media circus again. Any nearer to Christmas and people would have run out of money (and the hype drive) to replace their console instantly so they can play the latest must-have games like gow and cod5 online. :)

If I were to play a legit copy of one of these games, for instance the new Call of Duty on my flashed 360 will I still be banned? It sounds like everyone has done a number of things in a short period of time, all of which might cause a ban.

Is the game itself seeking out firmware, or are copies of the game being detected somehow?

My 2cent's

It has been mentioned over at BitSoup that the ban is focused on people who have played a review copy of recent new games(eg GOW2) SEED4me's releases are reported as being review copies (<-- this i cannot confirm/deny so maybe if someone else can?) but anyways this would match with other people saying they have been banned and play SEED4me's copies.

I agree, I definitely think one of the biggest problems for thos that have been banned are the ones that played the review copies.

also I would like to add I 'm playing a copy of GOW2 that was like the very first one out, like a month ago, and not a review copy and so far not banned, and hoping it'll stay that way.
