well thats good.. i have silver at the moment. planning on upgrading to gold, just didn't have to cashflow just yet. was hoping that if i were to upgrade to gold it wouldn't ban me after paying the 38 bucks

I've only ever had silver account and used 48 hour trial codes to play online.
I emailed M$ about using the hard drive from my banned console on a new unmodified rig, basically would the new console get banned, here is the response;
Thank you for contacting Xbox Email Support Team.
we would like to inform you that "One of the great things about LIVE and the unified community is that we work hard to create a level playing field for all gamers and have a no tolerance policy towards inappropriate behaviour like hacking or cheating.
As part of our commitment to our members, we do not allow people that we have detected to have modified their console to connect to XBOX LIVE. This is an important part of our efforts to try and maintain a fair gaming environment for the large majority of gamers that play by the rules.
This topic is more important than ever given the recent release of all these new online games, as a result some consumers that try to login to LIVE who we detect have illegally modified their console will get an error code (Status Code: Z: 8015 - 190D)* when trying to connect to the service. These users will not have their account automatically banned from LIVE, but they will no longer be able to access the service from the console they modified.
We have stated in the past that customers can only enjoy access to the Xbox LIVE community through the use of a genuine, unmodified, Xbox console and we will continue to enforce this rule to ensure the integrity of our service, the protection of our partners and the benefits of our users."
If you see the Status Code listed above, it indicates your console has been banned from Xbox Live for violations of the Terms of Use agreement. To protect the Xbox Live service and Xbox Live members, we do not provide details about console banning. There is no recourse for violations of the Terms of Use agreement.

like everyone's saying, there are possible ways of detecting people but i think their biggest way is monitoring who plays games early, and leaking games early with altered code for people to download and burn. as for ripping with kreon from the original disc. i don't see how they can find you. atleast for now.

I trully bulieve that the Ban Hammer was randomized, anyone can be still banned from live at any moment, why i was not banned from live since i have been playing GOW3 from the moment it was leaked online? thought i downloaded from newsgroups it doesn't mean anything, i'm still good on xbox live, order of game i've played lately
GOW3 (b4 official release, but not in online mode with other players)
Tomb Raider Underworld
Tomb raider Anniversary
Fallout 3 (after release)
DBZ burst limit
Prince Of persia
So... any ideas?

But yeah.. Back on topic.
I believe the ban wave is over. I've been playing backups on Live for the pass couple of weeks and haven't gotten banned. Most of the games are pretty recent too like Saints Row 2, Guitar Hero: World Tour, Gow 2.

as for now can't flash lite on drives just swap'em. buy the older drives on ebay for 35 bucks.

That's pretty dumb to do now, as
1. it's been found that LO's run a hidden command. So any drive which has been spoofed as a LO can be easily detected by MS over LIVE.
2. the new firmware to flash LO's will be released in 2 weeks.

how have things been going, are the bans starting to die down?
(like i posted a few weeks ago, it seems to have died down from the poeple ive spoken too but.. confirmation from all ends is always a good thing)
i just connected for about an hour.. no problems

if a person plays a pre-release game AFTER the game is officially released, can u still get in trouble? Or is a pre-release version of the game essentially an identical copy of the official game but that can get u in trouble if you play it BEFORE the official release date?
