i would take it back to tesco and give their customer service hell, tell them that you only bought the laptop due to them advertising it as having a 3 year warrenty and now you find it not to be true? im sure that tesco will sh@ themselves if you start talking about false advertising and trading standards.
as for the issue, does it have any power saving modes? if so switch them on to try and keep the heat down but tbh it sounds like its got a blockage of some kind and that is stopping the airflow.
from what i have seen about the ifx-14 is beating the true in the best air cooler stakes.

I did try downloading everest and speedfan
both strangely didnt seem to see the fan, couldnt find any temp reading in everest at all, fanspeed gave mad high readings on temp1 and temp2 but did not say what these were specifically ie cpu or ne thing
I did give tescos hell on the phone, i talked about trading standards and false advertising, i was incensed that they just seem to say o well its in the wrong packaging, that like buying heinz beans cos it says so on the can and getting peas or something when you open it, its false advertising lol, god its making me so mad lol

Check and see what your invoice says! That's what will be important. Check the numbers on the box with the numbers on the invoice! If the numbers match, threaten them with a Small Claims lawsuit! If the numbers match they'll have no choice but to take care of it, as they'll no longer have an argument!

Sounds like the board in your laptop is unfortunately not supported by Everest and other temperature monitoring programs. Another way of looking at it is to check the temperature of the laptop itself and see how hot the air coming out of it is. If it's unpleasantly hot in some areas, it's too hot, and if you can't feel air coming out of at least one of the vents, or can't hear a fan running, then something's up.
Ultimately though you should yell at tesco as the others have said.

nero vision is a fairly demanding program for a laptop anyway. you might try a laptop cooling pad. if you intend on using nero vision on a regular basis on your laptop, I would recommend a cooling pad even if there is/was no problem with the laptop. just my 2 cents.

Firstly, thank you to everyone who responded :)
Russ - yes the model number on box and invoice match, but acer say that tescos sold that model with and without the three year warranty, sounds like a load of crap to me, they say that the serial number of my laptop is not registered as being one with the 3 year warranty.
i say tough the box says so, so i want it!!! lol
sammorris - yep it does get unbelievably hot to touch at the bottom, i think the fan is still working but maybe not as effeciently as it should do
abbuzar1 - mad temps are: HDO says 45 but if i keep near a cold window i can get it down to 42ish, the others do not tell me what the readings are only temp1 = 71 and temp2 = 72, yep i did say they were mad high lol
mind you i just checked in speedfan today and they are all bout 54
mort81 - yep i did think bout cooling pad, i dont use nero vision that much but i am fed up in general with my laptop getting red hot, i still think their is a fault tho because its normal running temp seems too high

Those sound about right for a laptop that, is indeed overheating. 70C is probably the CPU core(s), which is hot, but not "mad". The HDD being above 45 is the big sign that it's hot in there, plus as you say, it being uncomfortably hot. The cheapest solution initially would be to find a laptop cooler.

Yeah Laptops CAN get that hot. I would either return it and get a different model or get a Laptop cooling pad like Mort said.

Keep pushing! Because the box says 3 year warranty and the serial number matches the one on the box, they don't have a leg to stand on. Remind them it only costs $37.50 to file in small claims Court, so unless they set this matter right, See you in Court! They know they can't win and will settle it! No Judge in the world is going to rule against you unless there is a disclaimer on the package of the Warranty!

Tesco's presumably in the UK, and in the UK the legal process is somewhat different, but I'm not sure how different.

I am trying to OC my E6600, but am having trouble keeping temp down. Its cooled by a arctic freezer 7 pro and the case has 10 fans (4x120mm side intake, 2x120mm rear exhaust, 1x120mm front intake, 1x80mm top exhaust). The room it is in is generally 25-35C.
Right now it is closer to 25/30C in the room and when I run TAT the temp hits ~55C @2.8Ghz.
I was thinking of replacing the stock fans but don't know which fans are good. Based on reviews the Scythe SY1225SL12H 120mm "Slipstream" Case Fan looks good, but I heard some of them leak oil. The SilenX IXP-76-18 120mm Case Fan looks good, but it got some sketchy reviews.
Any suggestions on dropping the temp?

Just your case man. That's a Crap load of fans.
You should look to optimize your airflow. Play around with the fans a bit see what you can do.
Also you have a Freezer 7 Pro. While it's great for the price it's not the best. I use it and my temps are kinda HIGH lol.

I'm not sure what you wanted to see so I uploaded side and rear photo to my My Profile. If its the model your after is a NZXT Zero. Also, I forgot to mention the slot fan I have beneath my 8800GTS (to keep it cool).

Thanks. Do you think better fans would help keep temps down? I don't know much about air flow or optimizing it. The inside of the case is as well organized as possible (for me) without purchasing longer cables. Most of my problem I believe comes from the ambient temp which is quite warm now and can be expected to rise 5-10C during summer.

It's much harder to cool a computer when the ambient temps are high to begin with. AC is fine, if you have it! If you don't, it becomes much more of a problem. It gets very warm here in SoCal. 115-117F in the summer months is about average for our area!
I've been using the same model Cooler Master Cavalier 3 case now for over a year, which is a decent sized Mid-Tower case (17.25"H x 8"W x19.50"D), and after a lot of experimenting with different fans, airflow direction and fan speeds, my case is cooled by 3 fans! 4 if you want to count the fan in the PSU. A single 80mm intake in the front (stock Cooler Master) that draws air from a vent in the bottom of the case, an 80mm exhaust fan on the side cover and a 120MM exhaust rear case fan. This creates negative air pressure inside the case and makes the static air vents draw lots of cooler air, that all moves at about 100 cfm! I use a Freezer 7 Pro to cool my CPU, and an Antec 40x40x20mm 6.5 cfm fan mounted to the heatsink to help cool the Northbridge and keep some of the heat away from the CPU. Shortly, I plan to install this Enzotech Chipset cooler with an Antec 40x40x20 6.5 cfm fan installed on it!

Putting an AC unit in a PC is asking for trouble. Doing it that cheaply is also asking for trouble. I'd avoid that case, even though the main negative review is from a complete idiot.
Stick to a proper case. It's hard to make a PC silent, especially in a warm climate, but it's a doddle to at least keep one cool, especially with a case like yours.
