As long as you pass this checklist, i think you will be okay.. however this is just MY experiances, theres also a few more things that can help
1)If you didnt flash your firmware too long ago (like i just did mine a month ago)
2)If you live outside of the US
those things can also seem to help
of course even with all this a ban is still possible, but this greatly increases your chances of staying safe
no 2 of my friend play all the game online before the release(fallout 3, GOW2....) and they dont hide their game list they got alot of 0gs and still not banned but me im banned since friday and its me that making the game for me and my friend btw im from canada

i have a question, i updated my dashboard into the NXE and i am not banned. my xbox 360 is currently on xbox lives as we speak. for some reason, i am a bit paranoid everytime when i have my xbox 360 on lives because i am scared that any minute from now i will get ban. is anyone here using the NXE with their modded xbox 360 and is still working fine?
btw i have the silver memebership, if that makes any difference.

ok a quick question
we've established that you can run back ups off the hdd with the new dashboard
but has any1 ever thought to put the original on the hdd, n the backup cd in the tray n run it like that?
will that help not gettin banned?

I thought that exact thing, maybe it will help as with the new dashboard update they possibly could only check the copy on the hard drive and not the disc. This could be one reason for so many bannings right b4 the update, because now it could be harder for microsoft to get ya!

The only thing M$ knows for sure is that you play bad rips. Even if you don't get banned right then it logs your ip and console id then hammer time...

hey im new to the xbox community so please bear with me as if i repeated a question that may have already been answered, i was curious to know (i have 2 systems 1 modded 1 not)
1. if i can get banned from the following, if my xbox doesnt have a XBL subscription i just leave it connected to see my friends can i get banned playing clones?
2. my sister saves her games on her hard drive and plays my clones, on my console, if hers isnt modded will that console get banned with the same provisions when she puts her Harddrive back on to her system? ( no XBL subscription just connects to see friends)
3. apparently its a console ban, what does that entail? the console is brick'd? of just XBL is unaccessable? can you still download things? connect to your friends when your brick'd

well i aint been on live for almost a week now and the last game i played a week ago was mortal kombat vs dc universe i have never played any game on live unless it is legit and i aint played gow 2 saints row 2 or cod 5 and the only time i connect a ethernet wire to my 360 is when i want to update a game as imporatant as fifa 09 lol yh well just downlaoded nxe and everythings fine 4 me so i think i survived the wave

Well here's one for you all.
1. Never played backup games online.
2. Sept 08 Got rrod, sent to ms (sydney australia), had repaired, received in return same xbox with new liteon drive. (they replace my modded ms28).
3. Didnt get box modded with any firmware or chip. is as received back from ms repair.
4. Used 1 month gold live free membership from ms support. played only halo 3 (bought game original). 1 month finished on 17th nov.
5. Yesterday, went to go on live for the update, says my console is banned.
6. MS said it must have picked up something in my box that it has been tampered with in some way. Also said if i put my hard drive onto another xbox360 then that 360 could also get banned. Must be something to do with my save games etc from prev backups. as i have a new liteon and its not modded in anyway since i got back from service in sydney.
So yeah this is happening outside the US.

As mentioned in most of the recent posts, the console logs what you have played regardless of being online or not. Apparently that data is sent when you do log on. Whether or not this is true, who knows. if it is true it is easy to assume that your console was on its way to being banned well before it was repaired. That said, did you ever play downloaded games or did you only play your own backups? Did you check them with mulleter or abgx?
There have also been complaints on other forums of repaird consoles being banned, maybe look into that? If it is a firmware thing or if they checked out your old drive that could also explain it, according to what I have read here.

does anyone know when is the new firmware coming up, maybe firmware 1.50 . the last update for 1.41 hasnt been updated much and havnet heard anything from the guy who came out with it.. we seriously need a fm 1.50 since the whole ban hamming thing is happening..

I really like this new NXE but i guess everything has pros and cons. i rather stick with the old dashboard, at least i werent paranoid at being banned.

Has anyone been banned after they went on NXE because it seems like no one is getting banned (Excluding those ppl who play leaked games and dashboard).
Maybe M$ is logging all the poeple who go on LIVE with modded xbox because they think its ok and once they have enough people they put down the banhammer.
Because if they would of banned people right from the start of the release of NXE there would be less modz going online for them to ban and waiting for 1.5.

HA went to download the new dash board and come to find out banned .. i have never played a game online . haven't even been on xbox live in like 6 months no joke was not even connected i know i wasn't banned during the last ban wave ..not to sure how they got me. last game i played a backup of was dead space who know just thought i would let you all know

The million dollar question is:
If we aren't already banned when we update to NXE, will they ban us if we start playing backups again? Or will they just leave us alone till the next wave?
I know people who have updated to NXE and are still playing backups with no problem so far...but if you ask me that is just asking to get banned later. Personally I'd rather wait for a new firmware to come out, just to play it safe.

Hi i got banned i for gotto unplug my consol from the net and they banned my gametag i was playing gow2 but i didn't play it on line i just forgot to unplug my net so i just set a new gametag i have not been banned again yet.you say that every game you play is recorded on the consol can you get ride of these games?
