As noted above in this thread, key words: "ahead of".
Also, if you looked at the link posted above, also in the thread, he said "We just wanted to get it out of the way ahead of preprations for the NXE".
Now the second part was probably in response to this: "they lept to a conclusion. It was just a normal ban run we process each day on our review of complaints. not a console one."
Now, without seeing the full discussion, I'm not sure what to say other than I don't buy it. Like, as said earlier, key words: "ahead of".
Sounds to me like 1) some people read too much into what was said. 2) Scare tactic.
If there was truly going to be a ban after the update, why would it be announced? Wouldn't they want to heard as many as possible?
I think there is just some clear misinformation going on there.
Of course this is all just my opinion.
Time will tell. I've installed NXE and no problems yet. I didn't even have to download the divx codecs again. That was strange as I've heard that you must do that. My movies ran fine off my thumbstick after updating to NXE.

All systems go with my Benq 1.3. Really like the NXE and as of now, I'm playing COD 4 so not banned :)
I got a virgin modded system hanging out in case the worst happens :)
No time for Leap frog!!!

Not banned with benq ixtreme 1.4. Just downloaded NXE works fine. Glad i hadnt touched that box for about 3 months. Got another virgin box aswell

I'm gonna be updating anyway I think, the benefits of caching to disk far outway getting kicked off live... as long as it doesn't red ring the console it's all good I think. Sadly, waiting until tonight since I'm at work for the next 7 hours! :(
@ Adambar - I don't think my last post said anything about M$ making money from the xbox's, although I think they do make a small profit now, but my point was they will get increased sales over the christmas period - cue lots of news articles of how big a success the xbox has been and how the ps3 flops in comparison... which is basically just as good a marketing campaign as you can buy, popularity drives sales (and a large percentage of xbox sales don't go to pirates!).
So, in my view sales!=profit... but I can see how it looked that way, my bad. :)

Anyone who has the new NXE, have you tried the Netflix streaming? I've read on a couple of news articles that it hasn't been working.

my main system got banned about a week ago (last thursday after playing a downloaded far cry 2 my mates got banned when going to dashboard from farcry2 same day)
my second system i risked on live today is not YET banned updated to NXE made an avatar and had a party chat all good so far
on my banned box i installed the leaked version and played some backups from the hard drive all seems good
but then if i was M$ i would run the ban hammer in a week or too (but im evil)

According to a mate of mine the update has a major gaping flaw in it - after you ripped your game to the hdd, you can basically run it with any disk in the dvd drive, not just the original which is what it was meant to be.
With obvious mistakes like that, makes you wonder what else they've messed up! :)
I expect they will patch it soon enough, or at least stop the roll-out of the current update... it would suck if it's pulled before I get home! :(

Had just installed Pure as it happens, then tried to run Halo 3 with Pure dvd in drive - it moaned and expects to see Halo 3 disc in drive - so you're out of luck on that one :P

Damn it all - I got really excited for a minute... I will check to see if he's just repeating what he's heard, or whether he's playing with the update himself... maybe regional versions are different? *fingers crossed*

i can second creaky. i installed GTA IV and midnight club: LA. after the GTA IV install, disc still in drive, i tried to play midnight club, and it threw the "insert game disc" notice.

The modded thing is an interesting idea though... I'm not sure a flashed dvd drive would make a difference if the nxe update was just reading a string which had the game's id/name or something simple like that.

lol - well I think we all will have to wait to be sure, as it might not be an instant ban... but nobody thinks anything new is implemented in the nxe that could be a new detection method... but there are always bad rips, your own gaming habits (20 games, no achievements, bit suspect, type thing) and all the usual stuff in the past.
People with modded machines are playing with the update, they said above - but there is always a risk of getting banned when modded, no 100% method to avoid it (other than not going online, but then that's what you are trying to avoid anyway isn't it?), so on your head be it! :)
